Stat. tit. 19, § 19-863.9","heading":"Subdivision plats - Rules and regulations","body":"From and after the adoption of a plan for major streets or\n\nhighways as a part of the master plan for the physical development\n\nof the area and the adoption of the rules and regulations\n\nhereinafter in this section provided for, no plat of a subdivision\n\nof land within the area shall be received for record in the office\n\nof the county clerk until it shall have been approved by the\n\nMetropolitan Area Planning Commission or the Commission's staff as\n\nprovided in the regulations, and such approval endorsed in writing\n\non the plat, and the filing or recording of such plat without such\n\napproval shall be without force or effect and shall be void as\n\nagainst public policy. No deed or other instrument of transfer\n\nreferring to such unapproved plat shall be valid, and if recorded,\n\nshall not import notice.\n\nThe approval of the Commission or the Commission's staff as\n\nprovided in the regulations required by this section or the refusal\n\nto approve shall take place within thirty (30) days from and after\n\nthe submission of the plat for final approval; otherwise said plat\n\nshall be deemed to have been approved and the certificate of said\n\nCommission as to the date of the submission of the plat for approval\n\nand as to the failure to take action thereon within such time shall\n\nbe sufficient in lieu of the written endorsement or evidence of\n\napproval herein required. The ground of refusal of any plat\n\nsubmitted, including citation to or reference to the rules or\n\nregulations violated by the plat shall be stated upon the record of\n\nthe Commission.\n\nIf the governing body of any city or town in the county protests\n\nagainst a subdivision plat of any land lying within three (3) miles\n\nof the limits of the incorporated area of such city or town, the\n\nplat shall be approved by not less than a two-thirds (2/3) favorable\n\nvote of the entire membership of the Commission with the reasons\n\ntherefor spread upon its minutes.\n\nSuch Commission shall adopt rules and regulations of uniform\n\napplication governing plats and subdivisions of land falling within\n\nits jurisdiction. Such regulations shall be designed to secure and\n\nprovide for the proper arrangement of streets or other highways in\n\nrelation to the existing or planned streets or highways or to the\n\nmaster plan or plans of the area; for adequate and convenient open\n\nspaces for traffic, utilities, access of firefighting apparatus,\n\nparking lots, parks, playgrounds, light and air; and for the\n\navoidance of congestion of population. The regulations may include\n\nprovisions authorizing the Commission's staff to approve or deny\n\nlot-splits as provided in Section 863.10 of this title, plats and\n\nother matters expressly identified in the regulations. Such\n\ndelegated authority shall be reserved for action in which the\n\nCommission or its staff is acting in a ministerial capacity. Said\n\nregulations may also include provisions as to the extent to which\n\nstreets and other highways shall be graded and improved and to which\n\nwater, sewer, or other utility mains, piping and other facilities\n\nshall be installed or assured as a condition precedent to the\n\napproval of the plat; the Council and/or the Board are hereby\n\nauthorized to prepare such specifications and to make such orders,\n\ninspections, examinations, and certificates as may be necessary to\n\nprotect and carry out such regulations and make them effective and\n\nto charge fees for services rendered and benefits involved as\n\nhereinafter provided or as may be provided by the respective\n\ngoverning bodies. Such rules and regulations shall provide for the\n\nmodification thereof by the Commission in specific cases where\n\nunusual topographical or other exceptional conditions may require\n\nthe same. Said regulations shall provide for a tentative approval\n\nof the plat previous to the installation or assurance of such\n\nimprovements and facilities, provided that any such tentative\nspective\n\ngoverning bodies. Such rules and regulations shall provide for the\n\nmodification thereof by the Commission in specific cases where\n\nunusual topographical or other exceptional conditions may require\n\nthe same. Said regulations shall provide for a tentative approval\n\nof the plat previous to the installation or assurance of such\n\nimprovements and facilities, provided that any such tentative\n\napproval shall be revocable and shall not be entered on the plat.\n\nSuch regulations may provide that in lieu of the completion of the\n\nconstruction of the required improvements and facilities prior to\n\nthe final approval of the plat, the Commission may accept bond in an\n\namount and with surety and conditions satisfactory to them,\n\nproviding for and securing to the Council and Board the actual\n\nconstruction of such improvement and facilities within a period\n\nspecified by the Commission, and the Council and Board are hereby\n\ngranted the power to enforce such bond by legal and equitable\n\nremedies. Such rules and regulations shall be adopted, changed, or\n\namended only after a public hearing has been held thereon by the\n\nCommission. Such hearing may be adjourned from time to time. The\n\nadoption of the rules and regulations or amendments thereto, as\n\nabove provided, shall be by resolution carried by not less than a\n\nmajority of the full membership of the Commission. Upon adoption by\n\nthe Commission, such rules and regulations or amendments thereto\n\nshall be certified to the Council, the Board, and to the county\n\nclerk of such county for safekeeping and as a public record, and\n\nshall be enforced as in this act provided.\n\nFor the purpose of this act, a subdivision is defined as any\n\ndivision of land into five or more lots, parcels, tracts, or areas,\n\nor any division of land involving the right-of-way or alignment of\n\nan existing or proposed street or highway.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"04939e734a9dde5da825ddd4a2783225cb5f42129a3d1ad0f94185ec16c4757c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-863.8","next":"us-ok/okla.-stat.-tit.-19-19-864.1"},"notice":"GroundRules: Original legal text.
