Stat. tit. 19, § 19-866.2","heading":"City and county powers","body":"\n\nIn any county of the state authorized to avail itself of the\n\nprovisions of this act and form with a city located therein a\n\ncooperative planning commission, such city is hereby empowered to\n\nadopt, amend, extend, add to or carry out a comprehensive plan for\n\nsuch city under the authority of existing statutes and laws and in\n\naddition is hereby authorized to establish a housing code in\n\naccordance with the provisions hereinafter set forth in this act,\n\nand it may also perform any additional urban planning which is\n\nneeded including, but not limited to, surveys, land use studies,\n\nurban renewal plans, conservation plans, technical service and other\n\nplanning work.\n\nSuch county is hereby granted authority to establish zoning\n\nregulations, a building code and construction codes and a housing\n\ncode in accordance with the provisions of this act for all the area\n\nlocated within three (3) miles of such municipality or within one-\n\nfourth (1/4) mile of any state or federal highway located anywhere\n\nin the county, or within one-half (1/2) mile of any water supply or\n\nreservoir owned by the municipality, excluding, however, any\n\nincorporated area, except as hereinafter provided; and further\n\nprovided that such county is hereby granted authority to adopt,\n\namend, extend, add to or carry out within the jurisdictional limits\n\nas provided by this act, excluding, however, any incorporated area\n\nand any unincorporated town which has been platted for more than ten\n\n(10) years, except as hereinafter provided, all additional elements\n\nof a comprehensive plan including, but not limited to, plans for\n\nmajor streets and highways and other elements of water, rail, air\n\nand land transportation plans, public facilities plans, capital\n\nimprovement programs, uniform regulations for land subdivision and\n\nfor the improvements located thereon, building line regulations,\n\nurban renewal plans and conservation plans. However, the provisions\n\nof this section shall not be construed to prohibit a municipality in\n\na metropolitan area planning commission from creating its own\n\nseparate planning commission to act within the boundary of the\n\nmunicipality. In every county of this state having an upstream\n\nterminal port and turnaround where navigation ends, or in any county\n\ncontaining all or any part of a reservoir or reservoirs constructed\n\nby the Bureau of Reclamation, the United States Army Corps of\n\nEngineers or by the Grand River Dam Authority, such county is hereby\n\ngranted authority, at the discretion of the board of county\n\ncommissioners, to establish zoning regulations, a building code and\n\nconstruction codes and a housing code in accordance with the\n\nprovisions of this act for all or any part of the unincorporated\n\narea within the county, and further provided that such county is\n\nhereby granted authority to adopt, amend, extend, add to or carry\n\nout, throughout the unincorporated area of the county, additional\n\nelements of a comprehensive plan including, but not limited to,\n\nplans for major streets and highways and other elements of water,\n\nrail, air and land transportation plans, public facilities plans,\n\ncapital improvement programs, uniform regulations for land\n\nsubdivision and for the improvements located thereon, building line\n\nregulations and conservation plans.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7324e84cb2c4509ee062e5c2681c36aa5bf46e16082a2b2fab6e07e30e927585","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-866.19","next":"us-ok/okla.-stat.-tit.-19-19-866.20"},"notice":"GroundRules: Original legal text.
