Stat. tit. 19, § 19-868.11A","heading":"Board of county commissioners may establish fines and","body":"penalties.\n\nA. A board of county commissioners may provide for enforcement\n\nof its regulations and establish fines, penalties or other remedies\n\nfor any offense in violation of its regulations, which shall be\n\nrecoverable together with costs of suit.\n\nB. 1. In addition to other powers and duties prescribed by\n\nlaw, a board of county commissioners shall have the power to\n\nestablish and enforce fines and penalties for violation of its\n\nzoning, subdivision, storm water and floodplain regulations,\n\nincluding the issuance of citations by designated county personnel\n\nfor violations of its zoning, subdivision, storm water and\n\nfloodplain regulations. A board of county commissioners may\n\nadditionally establish that any person who fails to correct a\n\nviolation for which a citation has been issued within the period\n\npermitted for its correction may be assessed a fine or penalty for\n\neach ensuing day during which such failure or violation continues.\n\n2. In issuing a citation pursuant to this subsection, the\n\ncounty employee shall proceed as follows:\n\na. the employee shall prepare a written citation to\n\nappear in court, containing the name and address of\n\nthe cited person and the violation/offense charged,\n\nand stating when the person shall appear in district\n\ncourt. The time to appear specified in the citation\n\nshall be at least five (5) days after the issuance of\n\nthe citation,\n\nb. one copy of the citation to appear shall be delivered\n\nto the person cited, and such person shall sign a\n\nduplicate written citation which shall be retained by\n\nthe county employee, and\n\nc. as soon as practicable, one copy of the citation shall\n\nbe filed with the district court specified therein and\n\none copy delivered to the prosecuting attorney.\n\n3. If a person fails to appear in district court at the\n\ndesignated time, a warrant for arrest shall be issued.\n\n4. Violations and penalties shall be deemed misdemeanor\n\noffenses, punishable by a fine of up to Five Hundred Dollars\n\n($500.00). Jurisdiction is hereby conferred upon the district court\n\nwithin the county.\n\n5. Fines and penalties collected pursuant to this subsection\n\nshall be deposited in the appropriate county fund.\n\n6.
