Stat. tit. 19, § 19-868.4","heading":"Staff and finances - Fees","body":"The county planning commission may appoint such employees as it\n\nmay deem necessary for its work and may contract with planners and\n\nother consultants for such services as it may require, and may incur\n\nother necessary expenses; provided that the expenditures of the\n\ncounty funds by the planning commission shall not be in excess of\n\nthe amounts appropriated for that purpose by the board of county\n\ncommissioners. It shall be lawful for the board of county\n\ncommissioners to appropriate funds for the administration of this\n\nact and to contract with the governing body of the county seat city\n\nto contribute jointly to pay expenses and salaries of a combined\n\nstaff to serve the county planning commission, county board of\n\nadjustment, city planning commission and city board of adjustment,\n\nand to provide offices for such combined staff either in the county\n\ncourthouse or the municipal building.\n\nFor building permits issued pursuant to this section, the county\n\nengineer shall collect a fee set by the county planning commission,\n\nwhich shall be approved every two (2) years by the board of county\n\ncommissioners. For each petition for amendments to zoning\n\nregulations, the county planning commission shall, upon approval and\n\nauthorization by the board of county commissioners, collect a fee\n\nsufficient to cover the cost of mailing notices and conducting\n\ninvestigations into the applicant's petition. In the event the\n\npetition is withdrawn by the applicant before consideration by the\n\ncounty planning commission but after notice and mailing of such\n\npublic hearing on applicant's amendments to zoning regulations or in\n\nthe event the applicant's petition is denied by the county planning\n\ncommission and an appeal is not pursued to the county board of\n\nadjustment, the applicant shall not be permitted to file another\n\npetition for amendment to zoning regulations covering the matter\n\nwithdrawn or denied until ninety (90) days from such withdrawal or\n\ndenial and upon payment of a nonrefundable fee as set by the county\n\nplanning commission, which shall be approved by the board of county\n\ncommissioners. All fees collected by the county planning commission\n\nand the county engineer shall be deposited with the county treasurer\n\ndaily, as is now provided by law, to the credit of the county\n\nplanning commission and such fees shall be placed in a separate fund\n\nto the credit of the said county planning commission, to be\n\ndesignated as the \"County Planning Commission Special Fund\", and\n\nshall be expended by the county planning commission, as follows:\n\nfor salaries of the staff or any member thereof, for mailing cost to\n\npotentially affected members of the public concerning notice of\n\npetitions for amendment to zoning regulations, for books, records,\n\nsupplies, fixtures and other necessary expenses incurred in the\n\noperation of said Planning Commission, provided that any of the fee\n\nso expended shall be upon verified claims duly filed, and approved\n\nby the board of county commissioners of the county as provided by\n\nlaw. Provided, however, that in the event the fees shall be in\n\nexcess of the necessary operating expenses of the planning\n\ncommission, said excess shall revert to the general fund of any such\n\ncounty at the end of the fiscal year. Provided further, that in the\n\nevent said fees shall not be sufficient to operate the planning\n\ncommission, the difference may be supplied by appropriation as\n\nprovided by law. On the first day of each month the county engineer\n\nand the county planning commission shall each submit to the board of\n\ncounty commissioners a verified report of all fees charged and\n\ncollected during the preceding month.\n\nFor each petition for an appeal to the board of adjustment, the\n\ncounty planning commission shall, upon approval and authorization by\n\nthe board of county commissioners, collect a fee sufficient to cover\nth the county engineer\n\nand the county planning commission shall each submit to the board of\n\ncounty commissioners a verified report of all fees charged and\n\ncollected during the preceding month.\n\nFor each petition for an appeal to the board of adjustment, the\n\ncounty planning commission shall, upon approval and authorization by\n\nthe board of county commissioners, collect a fee sufficient to cover\n\nthe cost of mailing notices and conducting investigations into the\n\napplicant’s petition.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8b3c8fced713f67236762dfa49601d532e4a278d9043425a902826beefdc36bf","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-868.3","next":"us-ok/okla.-stat.-tit.-19-19-868.5"},"notice":"GroundRules: Original legal text.
