Stat. tit. 19, § 19-869.4","heading":"Jurisdiction of commission","body":"The jurisdictional area of a lake area planning commission may\n\ninclude all or part of the unincorporated area of any county or\n\ncounties authorized to create such a planning commission, provided\n\nthat the jurisdictional area shall be limited to a three-mile\n\nperimeter from the normal shoreline elevation of the upstream\n\nterminal port or turnaround where navigation ends, or any reservoir\n\nor reservoirs constructed by the Bureau of Reclamation, the U.S.\n\nArmy Corps of Engineers or the Grand River Dam Authority, regardless\n\nof the population of the county or counties or the cities or towns\n\ntherein. In the event that the three-mile perimeter described above\n\nincludes portions of two or more counties, the counties may\n\ncooperate in a joint lake area planning commission; provided, that\n\nno lake area planning commission may establish or maintain any\n\njurisdictional area within any county or counties without a\n\nresolution of participation from the board of county commissioners\n\nof the county or counties.\n\nIn the event that all or part of an incorporated city or town\n\nlies within the three-mile perimeter, as described above, the\n\nincorporated areas may elect to come under the jurisdiction of the\n\nlake area planning commission. In the event that an incorporated\n\narea elects to come within the jurisdiction of a lake area planning\n\ncommission, the commission shall become the planning commission or\n\nzoning commission, or both, for the incorporated area or areas in\n\ntheir entirety, without regard for the three-mile perimeter from the\n\nnormal shoreline elevation.\n\nIn counties where a metropolitan area planning commission\n\nexists, the board of county commissioners may utilize that\n\ncommission in forming a lake area planning commission.\n\nIn no event shall the boundaries of any statutorily authorized\n\nplanning commissions overlap, and where a situation of overlap does\n\noccur, the jurisdictional question shall be settled on the basis of\n\nprior jurisdiction.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ec42df526ef0f5ad0497409d124946dc079f4409ebb597630e795e6907e34d6c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-869.3","next":"us-ok/okla.-stat.-tit.-19-19-869.5"},"notice":"GroundRules: Original legal text.
