Stat. tit. 19, § 19-869.6","heading":"Administration of zoning regulations - Board of","body":"adjustment.\n\nAt the discretion of the board or boards of county\n\ncommissioners, a lake area planning commission may be designated as\n\nthe zoning commission, for the purpose of establishing and\n\nadministering zoning regulations within its jurisdiction.\n\nIn the event that a board or boards of county commissioners\n\nelects to use the grant of zoning power herein provided, a board of\n\nadjustment, with the powers and duties established by Sections\n\n866.23 and 866.24 of this title, shall be created. The board of\n\nadjustment shall be composed of five (5) members, all of whom shall\n\nreside within the jurisdiction of the lake area planning commission.\n\nThe members shall be appointed in concert by all governing bodies\n\nparticipating in the planning commission.\n\nThe board of adjustment shall elect a chairman and other\n\nofficers as it may deem appropriate from among its members and shall\n\nadopt rules and procedures for the conduct of its business.\n\nZoning regulations established pursuant to this act (a) shall be\n\nmade in accordance with, and subsequent to, the preparation and\n\nadoption of a comprehensive plan for the desired jurisdictional\n\narea; (b) shall be adopted for the entire jurisdictional area of the\n\nappropriate governing body; (c) shall be uniform for each class or\n\nkind of building throughout each zoning district, provided, each\n\nzoning district may contain different regulations; (d) shall be\n\nadopted, amended or changed in accordance with the notice and public\n\nhearing requirements which apply to municipalities under Sections\n\n43-104, 43-105 and 43-106 of Title 11; and (e) may be enforced by\n\nappropriate actions, including the use of injunction for violations\n\nof the regulations.\n\nThe zoning power conferred herein shall not apply to the\n\nerection or use of the usual farm buildings for agricultural\n\npurposes, or to the planting of agricultural crops.\n\nThe lake area planning commission, when (a) properly formed, (b)\n\ndesignated as a zoning commission, and (c) operating as a joint\n\ncommission with a metropolitan area planning commission, shall be\n\nauthorized, at the discretion of the board or boards of county\n\ncommissioners, to exercise zoning powers and duties as provided in\n\nSections 866.16, 866.17, 866.18, 866.19, 866.20, 866.21, 866.22,\n\n866.23, 866.24, 866.25 and 866.30 of this title.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f2df40b3ae7f556aa7dd4afb1d15ab164df45ff05d249744cb169d379dd6739f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-869.5","next":"us-ok/okla.-stat.-tit.-19-19-869.7"},"notice":"GroundRules: Original legal text.
