Stat. tit. 19, § 19-872","heading":"Petition","body":"A petition shall be filed with the board of county commissioners\n\nsigned by a majority of the holders of title to lands in the\n\nproposed district desiring to be embraced in such district, which\n\npetition shall set forth the name of the proposed district, the\n\nboundaries of the proposed district, and shall pray that the same be\n\norganized into a sewer improvement district under the provisions of\n\nthis act. The petition must be accompanied by a map of the proposed\n\ndistrict, such map showing the boundaries of said district, and the\n\napproximate proposed location of sewer line or lines, and the sewage\n\ntreatment plant, if any. The map shall be drawn to a scale of not\n\nless than two (2) inches to the mile. The petitioners must\n\naccompany the petition with a good and sufficient bond, to be\n\napproved by the board of county commissioners in double the amount\n\nof the probable cost of organizing such district, conditioned that\n\nthe bondsmen will pay all costs in case said organization shall not\n\nbe effected. Such petition shall be filed with the county clerk.\n\nNotice shall be published one time at least ten (10) days before the\n\ntime at which such petition will be considered in some newspaper\n\nprinted and published in the county, stating the time when the\n\npetition will be considered by the board of county commissioners,\n\nand that all persons interested may appear and be heard. Such\n\nnotice, when published, shall contain therein a brief substance of\n\nthe contents of the petition. The board of county commissioners\n\nshall have exclusive jurisdiction to hear and determine all contests\n\nand objections to the creation of such district and all matters\n\npertaining to the same, and at the time set for said hearing the\n\nsame, the board may amend the plan for such improvement district by\n\nexcluding from within its boundaries any lands which it may deem\n\nwill not be benefited by the formation of such district, or by\n\nincluding other lands as a part of such district, upon the\n\napplication of the owner filed at or prior to said hearing. At such\n\nhearing said board shall also determine whether or not the formation\n\nof such improvement district as originally presented or in a\n\nmodified form will be conducive or beneficial to the public health\n\nand if said board determines that it will, then said board shall\n\nmake an order establishing such sewer improvement district subject\n\nto the result of an election to be held therein and said board shall\n\ngive notice of an election to be held in such proposed improvement\n\ndistrict for the purpose of determining whether or not the same\n\nshall be organized under the provisions of this act. Such notice\n\nshall describe the boundaries as established and shall designate a\n\nname for such proposed district and said notice shall be published\n\nfor at least two (2) weeks prior to said election in some newspaper\n\nof general circulation in the county. Such notice shall require the\n\nelectors to cast ballots which contain the words: \"Sewer\n\nImprovement District _______ Yes\", or \"Sewer Improvement District\n\n________ No\", or words equivalent thereto.
