Stat. tit. 19, § 19-876","heading":"Title to property - Sale of sewerage system - Election -","body":"Dissolution.\n\n(a) The legal title to all property acquired under this act\n\nshall immediately and by operation of law vest in such sewer\n\nimprovement district in its corporate name and shall be held by such\n\ndistrict in trust for, and is hereby dedicated and set apart to, the\n\nuses and purposes set forth in this act. The board of directors of\n\nsuch district is hereby authorized to hold, use, acquire, manage,\n\noccupy and possess such property as herein provided.\n\n(b) The board of directors shall have authority to contract for\n\nthe sale of the sewerage system of the district with a city or town,\n\nincluding the lines of conveyance, plant and other real or personal\n\nproperty used in connection therewith, on such terms as it believes\n\nto be for the best interests of the district, but no such contract\n\nshall be operative or valid until approved by a majority of the\n\nelectors of the district voting at a special election called for\n\nsuch purpose by the board of directors. Such special election shall\n\nbe called and conducted and notice thereof given as in the case of a\n\nspecial election on the issuance of bonds of the district. The\n\nboard of directors shall canvass the result of such special election\n\nand make record thereof in its minutes, and if the proposed contract\n\nshall have been approved at such election, the board of directors\n\nshall execute necessary conveyances to carry out the terms of the\n\ncontract; and the purchaser shall thereupon have the right to fix\n\nand collect reasonable tolls and charges for the use of the system\n\nso purchased. Provided, that the purchase price for such sewerage\n\nsystem shall not be less than the principal amount of the\n\noutstanding main sewer line and sewage disposal plant bonds\n\noutstanding plus the interest on said bonds to the first call date\n\nthereof. The proceeds of such sale shall be applied to the payment\n\nof the principal and interest of outstanding bonds of the district,\n\nand any excess shall be paid to the owners of the lots and pieces of\n\nground in the district, in proportion to the assessed value thereof.\n\n(c) After the execution of the necessary conveyances to carry\n\nout the terms of the contract for sale the board of directors shall\n\npay all outstanding valid claims for the operation and maintenance\n\nof the district.\n\nThe board of directors shall then make a report in writing to\n\nthe board of county commissioners, advising said county\n\ncommissioners of the sale of the district, including the terms of\n\nsale, disposition of the proceeds of the sale, that all valid claims\n\nfor operation and maintenance have been paid, and petitioning for\n\nthe dissolution of said district.\n\nThe board of county commissioners shall cause notice of said\n\npetition for dissolution to be published one (1) time in some\n\nnewspaper printed and published in the county and of general\n\ncirculation in the district at least ten (10) days before the time\n\nat which such petition will be considered. Such notice shall state\n\nthe time and place, when and where the petition will be considered\n\nby the board of county commissioners, a brief substance of the\n\npetition, and that all persons interested may appear and be heard.\n\nThe board of county commissioners shall have exclusive jurisdiction\n\nto hear and determine all contests and objections pertaining to such\n\ndissolution. At such hearing the board of county commissioners\n\nshall determine whether there is any reason or necessity for the\n\ncontinued existence of such district. If said board determines that\n\nthere is no reason or necessity for the continued existence of said\n\ndistrict it shall issue its order dissolving said sewer improvement\n\ndistrict, vacating all the offices thereof and discharging the\n\nofficers from further liability.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fa1bcdf1efc92c0c3cef0876a674c971fb546a131653cc23ad50f856dadf7fb2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-875","next":"us-ok/okla.-stat.-tit.-19-19-877"},"notice":"GroundRules: Original legal text.
