Stat. tit. 19, § 19-901.22","heading":"Including additional territory","body":"Any territory located within the same county of an existing\n\ndistrict may be included in the limits of such district by decision\n\nof the board of directors, certified to the board of county\n\ncommissioners, with the written consent of twenty-five percent (25%)\n\nof the holders of title to the territory sought to be included, or\n\nin the same manner as provided for the organization of fire\n\nprotection districts. Such territory shall not be included or added\n\nto the territory of the district without the consent of the board of\n\ndirectors and the board of county commissioners. In the event such\n\nterritory is included by decision of the board of directors, with\n\nthe consent of the board of county commissioners and the written\n\nconsent of twenty-five percent (25%) of the holders of title to the\n\nterritory sought to be included, the notice, hearing and order\n\nrequirements of Section 901.2 of this title and the notice and\n\nelection requirements of Sections 901.3 and 901.4 of this title\n\nshall be followed in the same manner as for the organization of fire\n\nprotection districts. In case any such territory is added to the\n\ndistrict the property therein shall immediately become subject to\n\nthe lien for the payment of bonds theretofore authorized by the\n\ndistrict in the same manner as property within the district at the\n\ntime of authorization of such bonds.\n\nAny territory adjacent to the existing district but within\n\nanother county may be included in the limits of such district by\n\ndecision of the board of directors, certified to the board of county\n\ncommissioners of both counties, with the written consent of twenty-\n\nfive percent (25%) of the holders of title to the territory sought\n\nto be included, or in the same manner as provided for the\n\norganization of fire protection districts. Such territory shall not\n\nbe included or added to the territory of the district without the\n\nconsent of the board of directors and the board of county\n\ncommissioners of each county. In the event such territory is\n\nincluded by decision of the board of directors, with the consent of\n\nthe board of county commissioners of each county and the written\n\nconsent of twenty-five percent (25%) of the holders of title to the\n\nterritory sought to be included, the notice, hearing and order\n\nrequirements of Section 901.2 of this title and the notice and\n\nelection requirements of Sections 901.3 and 901.4 of this title\n\nshall be followed in the same manner as for the organization of fire\n\nprotection districts. In case any such territory is added to the\n\ndistrict the property therein shall immediately become subject to\n\nthe lien for the payment of bonds theretofore authorized by the\n\ndistrict in the same manner as property within the district at the\n\ntime of authorization of such bonds.\n\nAny landowner whose property is within the response area of the\n\ndistrict as assigned by the county commissioners but is not within\n\nthe fire protection district itself may elect to opt into the\n\ndistrict by paying the assessment to the district.
