Full-time firefighters in a Rural Fire Protection District\n\nshall have the separate right to bargain collectively with their\n\nRural Fire Protection District and to be represented by a bargaining\n\nagent in such collective bargaining with respect to wages, salaries,\n\nhours, rates of pay, grievances, working conditions and all other\n\nterms and conditions of employment.\n\nB. Whenever, conformable to regulations that may be prescribed\n\nby the Public Employees Relations Board, a petition is filed by:\n\n1. A labor organization alleging that thirty percent (30%) of\n\nthe full-time firefighters in a Rural Fire Protection District:\n\na. wish to be represented for collective bargaining by an\n\nexclusive employee representative, or\n\nb. assert that the designated exclusive employee\n\nrepresentative is no longer the representative of the\n\nmajority of employees in the unit; or\n\n2. The employer alleging that one or more labor organizations\n\nhas presented to it a claim to be recognized as the exclusive\n\nemployee representative in an appropriate unit; the Board shall\n\ninvestigate the facts alleged therein and if it has reasonable cause\n\nto believe that a question of representation exists, it shall\n\nprovide for an appropriate hearing upon due notice. If the Board\n\nfinds upon the record of such hearing that such a question of\n\nrepresentation exists, it shall direct an election by secret ballot\n\nand shall certify the results thereof. The Board may also certify a\n\nlabor organization as an exclusive employee representative of a\n\nRural Fire Protection District if it determines that a free and\n\nuntrammeled election cannot be conducted because of the employer's\n\nunfair labor practices.\n\nC. Only those labor organizations which have been designated by\n\nmore than ten percent (10%) of the full-time firefighters in the\n\nunit found to be appropriate shall be placed on the ballot. Nothing\n\nin this section shall be construed to prohibit the waiving of or\n\nhearing by stipulation for the purpose of a consent election, in\n\nconformity with the rules and regulations of the Board.\n\nD. In order to assure to full-time firefighters in a Rural Fire\n\nProtection District the fullest freedom in exercising the rights\n\nguaranteed by this act, the Board shall decide in each case before\n\nit in which the issue is raised the unit appropriate for the\n\npurposes of collective bargaining, and shall consider such factors\n\nas community of interest, wages, hours and other working conditions\n\nof the firefighters involved, the history of collective bargaining,\n\nand the desires of the firefighters.\n\nE. An election shall not be directed in any bargaining unit or\n\nin any subdivision thereof within which, in the preceding twelve-\n\nmonth period, a valid election has been held. The Board shall\n\ndetermine who is eligible to vote in the election and shall\n\nestablish rules governing the election. In any election where none\n\nof the choices on the ballot receives a majority, but a majority of\n\nall votes cast are for representation by some labor organization, a\n\nrun-off election shall be conducted.
