Stat. tit. 19, § 19-901.30-2.2","heading":"Unfair labor practices - Complaint - Order to cease","body":"and desist - Restraining order.\n\nA. The Public Employees Relations Board is empowered, as\n\nhereinafter provided, to prevent any person, including a bargaining\n\nagent and corporate authorities, from engaging in any unfair labor\n\npractice as defined herein.\n\nB. Whenever it is charged that any person has engaged in or is\n\nengaging in any such unfair labor practice, the Board shall have the\n\npower to issue and cause to be served upon such person a complaint\n\nstating the charges in that respect and containing a notice of\n\nhearing before the Board, at a place therein fixed, not less than\n\nfive (5) days after the serving of the complaint. The respondent\n\nshall have the right to file an answer and to appear and give\n\ntestimony at the time and place fixed in the complaint. At the\n\ndiscretion of the Board, any other person may be allowed to\n\nintervene in such proceeding.\n\nC. If, upon the preponderance of the testimony taken, the Board\n\nshall be of the opinion that the person named in the complaint has\n\nengaged in or is engaging in any such unfair labor practice, then\n\nthe Board shall state its findings of fact and shall issue and cause\n\nto be served on such person an order requiring such person to cease\n\nand desist from such unfair labor practice. Such order may further\n\nrequire such person to make reports from time to time showing the\n\nextent to which it has complied with the order. If, upon the\n\npreponderance of the testimony taken, the Board shall not be of the\n\nopinion that the respondent has engaged in or is engaging in any\n\nsuch unfair labor practice, then the Board shall state its findings\n\nof fact and shall issue an order dismissing the complaint.\n\nD.
