Stat. tit. 19, § 19-901.56","heading":"Effectiveness of section - Coordinator defined -","body":"Consideration and determination of need of financial assistance -\n\nCertification - Distribution of monies - Expenditures.\n\nA. The provisions of this section shall become effective when\n\nfunds are made available for such purpose. Upon the availability of\n\nsuch funds, the State Department of Agriculture shall notify the\n\ncoordinator of such available funds.\n\nB. For the purposes of this section \"coordinator\" means the\n\nrural fire coordinator in each rural fire protection coordination\n\ndistrict as defined in Section 901.61 of this title.\n\nC. Upon notification of the State Department of Agriculture\n\npursuant to subsection A of this section on or before the last day\n\nof June of each year that funds are available for such purpose, the\n\ndistrict coordinators shall consider and determine the relative\n\nneeds of participants for monies in the Rural Fire Protection\n\nProgram Fund. Participants shall include incorporated cities under\n\nten thousand (10,000) population according to the latest Federal\n\nDecennial Census, towns, and legally formed rural fire departments.\n\nBased upon the information available to him, the coordinator shall\n\ncertify to the Commissioner of Agriculture the names of the\n\nincorporated cities, towns, and legally formed rural fire\n\ndepartments which he determines are in need of financial assistance\n\nfrom the Rural Fire Protection Program and the amount required by\n\neach in accordance with the provisions of this section. In making\n\nthis determination and certification, the coordinator shall consider\n\nthe intent and purpose of the Rural Fire Protection Program Fund\n\nAct. No incorporated city, town or legally formed rural fire\n\ndepartment shall receive monies distributed from the Rural Fire\n\nProtection Program Fund merely for the purpose of accumulation when\n\nsuch monies are not required to accomplish the purposes of this\n\nsection.\n\nD. In making such determination of needs, the coordinator shall\n\nfirst determine that each fire department to be certified has been\n\nduly formed under the appropriate state statutes.\n\nE. On or before the last day of August of each year, the State\n\nDepartment of Agriculture shall distribute the monies in the Rural\n\nFire Protection Program Fund in the manner provided by law.\n\nF. Any amount so distributed from the Rural Fire Protection\n\nProgram Fund to any eligible participant shall be expended only for\n\nthe maintenance of its fire department, the purchase, construction,\n\nmaintenance, repair and operation of its fire stations, fire\n\napparatus and equipment, the purchase, rental, installation or\n\nmaintenance of fire hydrants, the payment of insurance premiums upon\n\nfire stations, fire apparatus and equipment, and insurance premiums\n\nfor injuries or death of fire fighters, as otherwise provided by\n\nlaw. Provided, however, that no monies shall be expended from the\n\nfund for any purpose relating to the water supply systems of any\n\nparticipant, nor for the improvement or construction of such systems\n\nnor for any other appurtenances relating to the distribution or use\n\nof such water supply system. Monies so distributed from the Rural\n\nFire Protection Program Fund to any eligible participant may also be\n\nexpended, in an amount not to exceed ten percent (10%) of the\n\nallocated funds or the sum of One Thousand Dollars ($1,000.00) in\n\nthe aggregate during any period of one (1) year, whichever is\n\nlarger, for the expense of any fire fighters attending a certified\n\nfire school.\n\nG. No amount so distributed from the Rural Fire Protection\n\nProgram Fund to any eligible participant shall be expended or\n\nobligated for the purchase of land or the construction of buildings\n\nfor fire stations unless all obligations previously incurred for\n\nsuch purposes and to be paid from monies distributed from the Rural\n\nFire Protection Program Fund by such eligible participant have been\n\nfully paid and satisfied. No monies from the fund shall be expended\ngram Fund to any eligible participant shall be expended or\n\nobligated for the purchase of land or the construction of buildings\n\nfor fire stations unless all obligations previously incurred for\n\nsuch purposes and to be paid from monies distributed from the Rural\n\nFire Protection Program Fund by such eligible participant have been\n\nfully paid and satisfied. No monies from the fund shall be expended\n\nor obligated for the construction of buildings for fire stations\n\nunless the participant proposing to expend or obligate monies\n\ndistributed from the Rural Fire Protection Program Fund for that\n\npurpose holds fee simple title, not encumbered by any lien, or holds\n\na lease for a period of not less than ten (10) years, with\n\nprovisions for renewal of the lease annually, to the land on which\n\nit proposes to construct any such building. Provided, however, that\n\nthis provision shall not prohibit construction or location of a fire\n\nstation on land donated in whole or part to the participant for the\n\npurpose, and use of Rural Fire Protection Program Fund monies for\n\nsuch construction or location, where the donor has reserved right or\n\nreversion of such land under stated conditions, if such use be\n\nappropriate and reasonable.\n\nH. Amounts so distributed from the Rural Fire Protection\n\nProgram Fund to any eligible participant shall be expended under the\n\ndirection of the chief of the fire department upon duly executed\n\nvouchers approved as required by law.
