Stat. tit. 19, § 19-901.5A","heading":"Election procedures in lieu of election procedures set","body":"out in Section 901.5.\n\nA. The board of directors of a fire protection district is\n\nhereby authorized to adopt, by resolution, the election procedures\n\nset out in this section in lieu of the election procedures set out\n\nin Section 901.5 of Title 19 of the Oklahoma Statutes.\n\nB. The board of directors shall divide the fire protection\n\ndistrict into as many voting districts as there are members of the\n\nboard. Such voting districts shall, as nearly as feasible and\n\npractical, follow clearly visible, definable and observable physical\n\nboundaries which are based upon criteria established and recognized\n\nby the Bureau of the Census of the United States Department of\n\nCommerce for purposes of defining census blocks for its decennial\n\ncensus and shall follow precinct boundary lines as nearly as\n\npractical. Voting districts shall be compact, contiguous and as\n\nequal in population as practical with not more than a ten percent\n\n(10%) variance between the most populous and least populous\n\ndistricts, according to the results of the most recent Federal\n\nDecennial Census. The board shall redraw voting districts no later\n\nthan June 30 of any year in which the results of a Federal Decennial\n\nCensus are released which shows a population variance of more than\n\nten percent (10%) between the most populous and least populous\n\ndistricts and at any time a board increases its membership pursuant\n\nto subsection C of Section 901.5 of Title 19 of the Oklahoma\n\nStatutes. The voting districts may not be redrawn at any other\n\ntime.\n\nC. The registered voters of each voting district shall elect\n\none member of the board of directors of the fire protection\n\ndistrict. A member shall be required to be a registered voter of\n\nthe voting district which elects such member.\n\nD. 1. Vacancies on the board shall be filled by the board of\n\ndirectors. In the event a vacancy occurs and the remaining members\n\nof the board are unable to make a decision on such vacancy within\n\nsixty (60) calendar days, the board of county commissioners shall\n\nimmediately appoint a member to fill the vacancy. In the event the\n\nvacancies on the board are so numerous as to not provide a quorum,\n\nthe board of county commissioners shall appoint as many members as\n\nare necessary to make a quorum.\n\n2. Appointments to fill a vacancy pursuant to this section may\n\nnot result in more than two board members being residents of the\n\nsame voting district.\n\n3. All vacancies filled pursuant to the provisions of this\n\nsubsection shall be filled until the next regular election, at which\n\ntime a member shall be elected to serve the remainder of the\n\nunexpired term.\n\nE. 1. The office of a member of the board of directors may be\n\ndeclared vacant by the board of directors if such member:\n\na. is absent from more than one-half (1/2) of all\n\nmeetings of the board of directors, regular and\n\nspecial, held within any period of four (4)\n\nconsecutive months,\n\nb. ceases to be eligible for office pursuant to this\n\nsection,\n\nc. has a conviction in a court of any felony or crime\n\ninvolving moral turpitude,\n\nd. uses alcohol, any stimulant, any drug or other\n\nsubstance which impairs intellect, judgment or\n\nphysical ability to such an extent as to incapacitate\n\nthe member to such a degree that the member is\n\nprevented from performing duties pursuant to Chapter\n\n21 of this title,\n\ne. has a mental or physical weakness or inability which\n\nincapacitates the member to such a degree that the\n\nmember is prevented from performing duties required\n\npursuant to Chapter 21 of this title, or\n\nf. has served the term for which elected and no person\n\nhas filed for election for the office of such member.\n\n2. Vacancies determined pursuant to this subsection shall be\n\nfilled pursuant to subsection D of this section after notice to the\n\nboard member of such action and opportunity for a hearing.\nthe\n\nmember is prevented from performing duties required\n\npursuant to Chapter 21 of this title, or\n\nf. has served the term for which elected and no person\n\nhas filed for election for the office of such member.\n\n2. Vacancies determined pursuant to this subsection shall be\n\nfilled pursuant to subsection D of this section after notice to the\n\nboard member of such action and opportunity for a hearing.\n\n3. Vacancies shall be determined at an official meeting of the\n\nboard and shall be a specific agenda item.\n\n4. Any appeal from a decision declaring an office vacant\n\npursuant to this subsection shall be made to the district court\n\nwithin thirty (30) days of such determination.\n\nF. Election procedures for the board of directors of a fire\n\nprotection district may not be changed between the procedures set\n\nout in Section 901.5 of Title 19 of the Oklahoma Statutes and the\n\nprocedures set out in this section more often than one time in any\n\nten-year period.\n\nG.
