Stat. tit. 19, § 19-902.3","heading":"Petition - Deposit - Filing - Hearing - Orders -","body":"Election.\n\nThe petition shall set forth and particularly describe the\n\nproposed boundaries of such district and shall be accompanied by a\n\nmap of such proposed district. The petitioners shall accompany such\n\npetition with a cash deposit, the amount of which shall be approved\n\nby the board of county commissioners. The cash shall be deposited\n\nwith the county treasurer in a special fund which shall be used for\n\nthe purposes of defraying the costs of the publications and of the\n\nelection for the organization of the district. Any unused portion\n\nof the amount deposited shall be refunded to the petitioners upon\n\nrequest.\n\nThe petition shall be filed with the county clerk of such county\n\nwho shall present it to the board of county commissioners at their\n\nnext regular or special meeting. Upon the presentation of the\n\npetition, the board of county commissioners shall set the petition\n\nfor hearing at a time not less than twenty (20) days nor more than\n\nforty (40) days from the date of presentation and shall direct the\n\ncounty clerk to give notice of the hearing by publication in a\n\nnewspaper of general circulation in the county in which the proposed\n\ndistrict is located. The notice shall be published one (1) day a\n\nweek for two (2) consecutive weeks preceding the date of such\n\nhearing. The notice shall describe the boundaries of the proposed\n\ndistrict, shall state the time and place of the hearing, and shall\n\nstate that any person may appear and protest the organization of the\n\ndistrict or the proposed boundaries of the district.\n\nThe board of county commissioners shall hold the hearing\n\ndescribed in the notice, and it shall have jurisdiction to hear and\n\ndetermine all protests to the creation of such district and all\n\nmatters pertaining to the same. It may amend the plan of the\n\ndistrict by excluding from within its boundaries any lands which it\n\nmay deem will not be benefited by the formation of such district, or\n\nby including other lands as a part thereof upon application of the\n\nowners of such land. However, it shall not exclude from such\n\ndistrict any lands which are completely surrounded by lands which\n\nare included in the proposed district.\n\nAt the conclusion of the hearing, the board of county\n\ncommissioners shall make an order determining the boundaries of the\n\nproposed district, particularly describing them, and shall determine\n\nwhether the formation of such district will be conducive to the\n\nimprovement of safe travel in the incorporated area. If the board\n\ndetermines that the district will be conducive to safe travel in the\n\narea incorporated in the district and will be in the best interests\n\nof the people residing or owning real property in the district, then\n\nthe board may give the proposed district a name and call an election\n\nof the registered voters in the territory comprising such proposed\n\ndistrict, or if there are no registered voters in the territory\n\ncomprising the proposed district, call an election of the owners of\n\nreal property in the territory comprising the proposed district who\n\nare registered voters, on the question of whether the district shall\n\nbe organized.
