Effective July 1, 1999, each county of the state may\n\nestablish a County Officer and Employee Deferred Savings Incentive\n\nPlan as authorized by this act.\n\nB. A county electing to establish a County Officer and Employee\n\nDeferred Savings Incentive Plan shall establish a County Officer and\n\nEmployee Deferred Savings Incentive Plan Fund for the payment of\n\nmatching employer contributions as provided by this section, subject\n\nto the limit upon the amount of the matching employer contribution\n\nas provided by law. The participating employer shall pay the\n\ncontributions from the same source of funds used in paying salary to\n\nthe county officer or employee.\n\nC. Subject to the limit imposed by subsection D of this\n\nsection, for each qualified participant as defined in this section,\n\nthe board of county commissioners of each county electing to\n\nestablish a County Officer and Employee Deferred Savings Incentive\n\nPlan shall pay each month from the County Officer and Employee\n\nDeferred Savings Incentive Plan Fund a sum equal to the amount\n\ncontributed each month by the participating county officer or\n\nemployee to the deferred compensation plan account established for\n\nthe participant pursuant to Section 457 of the Internal Revenue Code\n\nof 1986, as amended.\n\nD. The board of county commissioners of each county shall set\n\nthe amount of county contribution.\n\nE. The payment of the matching employer contribution as\n\nauthorized by this section by any county electing to establish a\n\nCounty Officer and Employee Deferred Savings Incentive Plan shall be\n\nmade to a plan established pursuant to the Internal Revenue Code,\n\nSection 401(a), for the benefit of the officers and employees of the\n\ncounty.\n\nF. For the purposes of this section, \"qualified participant\"\n\nmeans a:\n\n1. \"County employee\" as defined by Section 957 of this title\n\nwho is a participant in a deferred compensation plan established by\n\nthe county pursuant to Section 457 of the Internal Revenue Code of\n\n1986, as amended; and\n\n2. \"County officer\" as defined by Section 131 of this title who\n\nis a participant in a deferred compensation plan established by the\n\ncounty pursuant to Section 457 of the Internal Revenue Code of 1986,\n\nas amended.\n\nG. The board of county commissioners for each county electing\n\nto create a County Officer and Employee Deferred Savings Incentive\n\nPlan shall be responsible for establishing rules and plan documents\n\nfor administration of the plan and all contributions made to the\n\nplan.\n\nH. Pursuant to the requirements of Section 10 of Article XXIII\n\nof the Oklahoma Constitution, no county officer shall be able to\n\nreceive matching contributions in the County Officer and Employee\n\nDeferred Savings Incentive Plan account described by this section\n\nduring a term of office which commenced prior to the effective date\n\nof this act.
