Sections 10-9.1 through 10-9.12 of this title shall be known\n\nand may be cited as the \"Oklahoma Registered Poultry Feeding\n\nOperations Act\".\n\nB. As used in Sections 10-9.1 through 10-9.23 of this title:\n\n1. \"Best Management Practices\" or \"BMPs\" means schedules of\n\nactivities, prohibitions of practices, maintenance procedures, and\n\nother management practices which prevent or reduce the pollution of\n\nwaters of the state as established by the Oklahoma Department of\n\nAgriculture, Food, and Forestry pursuant to Section 10-9.7 of this\n\ntitle;\n\n2. \"Board\" means the State Board of Agriculture;\n\n3. \"Certificate\" means a written document issued to an\n\nindividual by the Board pursuant to Section 10-9.17 of this title\n\nwhich indicates that the individual is authorized to land-apply\n\npoultry waste by the Oklahoma Poultry Waste Applicators\n\nCertification Act;\n\n4. \"Certified poultry waste applicator\" means a person who has\n\nbeen certified by the Board to land-apply poultry waste and includes\n\na commercial poultry waste applicator and a private poultry waste\n\napplicator;\n\n5. \"Commercial poultry waste applicator\" means any person who\n\nengages in commercial land-application of poultry waste. Any farmer\n\nwhile working for a neighbor in agricultural production, and not\n\nadvertising, nor holding himself or herself out to be in the\n\nbusiness of land-applying poultry waste, shall not be classified as\n\na commercial poultry waste applicator, but as a private poultry\n\nwaste applicator;\n\n6. \"Contract growing arrangement\" means any growout contract,\n\nmarketing agreement, or other arrangement under which a contract\n\npoultry grower cares for or raises poultry;\n\n7. \"Contract poultry grower\" means any person engaged in the\n\nbusiness of caring for or raising poultry, under a contract growing\n\narrangement;\n\n8. \"Common ownership\" includes but is not limited to any person\n\nwho has power or authority to manage, direct, restrict, regulate or\n\noversee the operation or has financial control of two or more\n\npoultry feeding operations;\n\n9. \"Department\" means the Oklahoma Department of Agriculture,\n\nFood, and Forestry;\n\n10. \"Expanding operation\" means a registered poultry feeding\n\noperation that seeks to increase its registered capacity in excess\n\nof ten percent (10%) of the facility's original registered capacity;\n\n11. \"Facility\" means any place, site or location or part\n\nthereof where poultry are kept, handled, housed or otherwise\n\nmaintained including but not limited to buildings, lots, pens, and\n\npoultry waste management systems;\n\n12. \"Integrator\" means an entity which unites the elements\n\nassociated with the poultry industry, including but not limited to\n\nhatching, feeding, processing, and marketing. It includes, but is\n\nnot limited to, situations when growing is contracted out to others\n\nand when the integrator operates its own growing facilities;\n\n13. \"Land-application\" means the spreading on, or incorporation\n\ninto, the soil mantle primarily for beneficial purposes;\n\n14. \"Nutrient Management Plan\" means a written plan that\n\nincludes a combination of conservation and management practices\n\ndesigned to protect the natural resources of the state as required\n\nby the Oklahoma Department of Agriculture, Food, and Forestry\n\npursuant to the provisions of Section 10-9.7 of this title and shall\n\nalso include a certified nutrient management plan and animal waste\n\nmanagement plan;\n\n15. \"Operator\" means the person who performs the daily\n\nmanagement functions associated with the poultry feeding operation;\n\n16. \"Person\" means an individual, association, partnership,\n\nfirm, company, public trust, corporation, joint stock company, trust\n\nestate, any other legal entity, or any agent, employee,\n\nrepresentative assignor or successor thereof;\n\n17. \"Nutrient-limited watershed\" means a watershed of a water\nthe person who performs the daily\n\nmanagement functions associated with the poultry feeding operation;\n\n16. \"Person\" means an individual, association, partnership,\n\nfirm, company, public trust, corporation, joint stock company, trust\n\nestate, any other legal entity, or any agent, employee,\n\nrepresentative assignor or successor thereof;\n\n17. \"Nutrient-limited watershed\" means a watershed of a water\n\nbody which is designated as \"nutrient-limited\" in the most recent\n\nOklahoma Water Quality Standards;\n\n18. \"Nutrient-vulnerable groundwater\" means groundwater which\n\nis designated \"nutrient-vulnerable\" in the most recent Oklahoma\n\nWater Quality Standards;\n\n19. \"Poultry\" includes chickens, turkeys, ducks, geese, and any\n\nother domesticated bird used for human food and/or animal feed;\n\n20. \"Poultry feeding operation\" means a property or facility\n\nwhere the following conditions are met:\n\na. poultry have been, are or will be confined and fed or\n\nmaintained for a total of forty-five (45) days or more\n\nin any twelve-month period,\n\nb. crops, vegetation, forage growth or post-harvest\n\nresidues are not sustained in the normal growing\n\nseason over any portion of the property or facility,\n\nand\n\nc. producing over ten (10) tons of poultry waste per\n\nyear;\n\n21. \"Poultry waste\" means poultry excrement, poultry carcasses,\n\nfeed wastes, bedding materials, or any other waste associated with\n\nthe confinement of poultry from a poultry feeding operation;\n\n22. \"Poultry waste management system\" means a combination of\n\nstructures and practices serving a poultry feeding operation that\n\nprovides for the collection, treatment, disposal, distribution,\n\nstorage, and land-application of poultry waste;\n\n23. \"Private poultry waste applicator\" means any person who is\n\nnot a commercial poultry waste applicator but engages in the land\n\napplication of poultry waste for purposes including, but not limited\n\nto, producing any agricultural commodity on property owned or rented\n\nby the person or such person's employer, or if applied without\n\ncompensation other than trading of personal services between\n\nproducers of agricultural commodities, on the property of another\n\nperson;\n\n24. \"Waste facility\" means any structure or combination of\n\nstructures utilized to control poultry waste until it can be\n\nutilized in an authorized manner; and\n\n25. \"Waters of the state\" means all streams, lakes, ponds,\n\nmarshes, watercourses, waterways, wells, springs, irrigation\n\nsystems, drainage systems, storm sewers, and all other bodies or\n\naccumulations of water, surface and underground, natural or\n\nartificial, public or private, which are contained within, flow\n\nthrough or border upon this state or any portion thereof, and shall\n\ninclude under all circumstances the waters of the United States\n\nwhich are contained within the boundaries of, flow through or border\n\nupon this state or any portion thereof.
