It shall be unlawful and a misdemeanor punishable by a fine\n\nof not more than Five Thousand Dollars ($5,000.00) for any person to\n\nact, operate, or do business or advertise as a commercial poultry\n\nwaste applicator or to land-apply poultry waste as a private poultry\n\nwaste applicator unless such person has obtained a valid\n\napplicator’s certificate issued by the Oklahoma Department of\n\nAgriculture, Food, and Forestry.\n\nB. Applicator’s certificates shall be issued by the Department\n\nto applicants who qualify under the provisions of the Oklahoma\n\nPoultry Waste Applicators Certification Act.\n\nC. Certificates shall be issued only upon application therefor\n\nto the Department on a form of application prescribed by the\n\nDepartment. The application shall contain information regarding the\n\napplicant’s qualifications and proposed operations and such other\n\ninformation as may be specified by the Department.\n\nD. A certificate shall be issued only after satisfactory\n\ncompletion of such certification standards as determined by the\n\nDepartment.\n\nE. 1. The Department shall issue a commercial applicator\n\ncertificate for a five-year period if a properly completed\n\napplication is filed with the Department not later than the first\n\nday of January of the subsequent five-year period. A registration\n\nfee of Seventy-Five Dollars ($75.00) shall accompany every initial\n\nand renewal application for certification.\n\n2. The Department shall issue a private applicator certificate\n\nfor a five-year period if a properly completed application is filed\n\nwith the Department not later than the first day of January of the\n\nsubsequent five-year period. A registration fee of Fifteen Dollars\n\n($15.00) shall accompany every initial and renewal application for\n\ncertification. The Fifteen Dollar ($15.00) registration and renewal\n\nfee shall be waived if the private applicator is also registered\n\npursuant to the Oklahoma Registered Poultry Feeding Operations Act.\n\n3. The Department shall issue all certificates for five-year\n\nperiods beginning January 1, 2025, and expiring on December 31,\n\n2029, followed by successive five-year periods.\n\n4. All such fees shall be deposited in the Agriculture\n\nRegulation Revolving Fund to be used for the purpose of implementing\n\nthe provisions of the Oklahoma Registered Poultry Feeding Operations\n\nAct and the Oklahoma Poultry Waste Applicators Certification Act.\n\nF.
