The State Board of Agriculture shall provide the necessary\n\nforms and applications for any person desiring or required to\n\nregister a poultry feeding operation or expanding operation.\n\nB. The application to register to operate a new or previously\n\nunregistered poultry feeding operation or expanding operation shall\n\ncontain, at a minimum, the following information:\n\n1. Name and address of the owner and operator of the facility;\n\n2. Name and address of the poultry feeding operation;\n\n3. Number and type of poultry housed or confined;\n\n4. Name and address of the integrator whose poultry will be\n\nraised by the poultry feeding operation;\n\n5. A diagram or map and legal description showing geographical\n\nlocation of the facility on which the perimeters of the facility are\n\ndesignated, location of waters of the state, including, but not\n\nlimited to, drainage from the facility, poultry waste storage\n\nfacilities, and land-application sites owned or leased by the\n\napplicant or which the applicant has contracted with for the\n\napplication of poultry waste;\n\n6. A copy of the Nutrient Management Plan, or proof of\n\napplication for such plan, Best Management Practices or any other\n\nplans authorized by the Oklahoma Department of Agriculture, Food,\n\nand Forestry;\n\n7. A statement of ownership.\n\na. If the applicant is a corporation, the name and\n\naddress of the corporation and the name and address of\n\neach officer and registered agent of the corporation\n\nshall be included in the application.\n\nb. If the applicant is a partnership or other legal\n\nentity, the name and address of each partner and\n\nstockholder with an ownership interest of ten percent\n\n(10%) or more shall be included in the statement.\n\nc. The information contained in the statement of\n\nownership shall be public information and shall be\n\navailable upon request from the Board;\n\n8. The name and address of the person having day-to-day control\n\nof the operation, if such person is not the applicant and is acting\n\nas agent for the applicant;\n\n9. An environmental history from the past three (3) years of\n\nany poultry feeding operation established and operated by the\n\napplicant or any other operation with common ownership in this state\n\nor any other state;\n\n10. Environmental awards or citations received or pollution\n\nprevention or voluntary remediation efforts undertaken by the\n\napplicant; and\n\n11. Any other information or records required by the Department\n\nfor purposes of implementing the Oklahoma Registered Poultry Feeding\n\nOperations Act or rules promulgated pursuant thereto.\n\nC. In addition to other penalties as may be imposed by law, any\n\nperson who knowingly makes any false statement, representation, or\n\ncertification in, omits material data from, or tampers with any\n\napplication for registration shall, upon conviction, be guilty of a\n\nmisdemeanor and may be subject to a fine not more than Ten Thousand\n\nDollars ($10,000.00) for each such violation.\n\nD. The owner of a poultry feeding operation shall be\n\nresponsible for sending written notification to the Department upon\n\nchanging integrators.\n\nE. For a transfer of registration to a new owner, the new owner\n\nshall register the operation pursuant to the rules of the\n\nDepartment.\n\nF. 1. All operators of poultry feeding operations and poultry\n\nwaste applicators shall attend educational courses on poultry waste\n\nhandling. All such operators and applicators shall attend\n\neducational training on poultry waste management as provided by\n\nOklahoma State University through the Cooperative Extension Service.\n\nAll current and new operators and applicators shall receive the\n\ninitial nine (9) hours of training in the first year and two (2)\n\nhours of continuing education every year until the operator or\nultry waste\n\nhandling. All such operators and applicators shall attend\n\neducational training on poultry waste management as provided by\n\nOklahoma State University through the Cooperative Extension Service.\n\nAll current and new operators and applicators shall receive the\n\ninitial nine (9) hours of training in the first year and two (2)\n\nhours of continuing education every year until the operator or\n\napplicator has received a total of nineteen (19) hours of training.\n\nAny operator or applicator may attend more hours than is required;\n\nhowever, those hours shall not be carried forward. Upon receiving\n\nthe nineteen (19) required hours, the operator or applicator shall\n\nbe required to receive two (2) hours of continuing education every\n\nthree (3) years. The Cooperative Extension Service shall develop\n\nthe educational training course to aid in certification. Curricula\n\nfor the training course will include the Cooperative Extension\n\nService waste management facts series and record books or their\n\ncurrent equivalent. Courses for poultry waste management shall\n\ninclude the following topics:\n\na. environmental process relevant to protecting water\n\nquality in poultry production,\n\nb. basic handling systems to manage poultry waste from\n\nall types of poultry operations,\n\nc. nutrient management, including sampling procedures,\n\napplication rate determination, equipment calibration,\n\nand record-keeping systems,\n\nd. relevant laws and rules applicable to poultry waste\n\nmanagement in this state, and\n\ne. any other related subject as determined by Oklahoma\n\nState University in consultation with the Department.\n\n2. At the completion of each course, the operator or applicator\n\nshall receive a certification verifying completion. The\n\ncertificates shall be kept on site for five (5) years.\n\n3. Failure to obtain the initial nine-hour training and any\n\ncontinuing education as provided in this subsection shall be deemed\n\na violation of the Oklahoma Registered Poultry Feeding Operations\n\nAct for operators and the Oklahoma Poultry Waste Applicators\n\nCertification Act for applicators.\n\n4. All operators or applicators shall meet the educational\n\nrequirements of this section no later than December 31 of each year.\n\n5. All operators and applicators are solely responsible for\n\nobtaining and maintaining all educational requirements established\n\npursuant to the provisions of this subsection.\n\nG.
