Stat. tit. 2, § 2-10-9.7","heading":"Utilization of Best Management Practices - Nutrient","body":"management plans - Soil testing - Carcass disposal plan.\n\nA. All poultry feeding operations shall utilize Best Management\n\nPractices and shall meet the conditions and requirements established\n\nby subsection B of this section and by rules promulgated by the\n\nState Board of Agriculture pursuant to the Oklahoma Registered\n\nPoultry Feeding Operations Act. Compliance with a Nutrient\n\nManagement Plan developed under subsections B and C of this section\n\nshall be deemed compliant with Best Management Practices.\n\nB. Best Management Practices shall be promulgated by rules by\n\nthe Board and shall include, but not be limited to, the following\n\nwhen developing Nutrient Management Plans:\n\n1. Measures designed to prevent the discharge of poultry waste\n\nto waters of the state;\n\n2. Measures requiring stored poultry waste shall be isolated\n\nfrom outside surface drainage by covers, ditches, dikes, berms,\n\nterraces, or other such structures;\n\n3. Measures designed to prevent waters of the state from coming\n\ninto direct contact with the poultry confined on the poultry feeding\n\noperation; and\n\n4. Measures designed to ensure that poultry waste handling,\n\ntreatment, management, and removal shall:\n\na. not create an environmental or a public health hazard,\n\nb. not result in the contamination of waters of the\n\nstate, and\n\nc. conform to such other handling, treatment, and\n\nmanagement and removal requirements deemed necessary\n\nby the Oklahoma Department of Agriculture, Food, and\n\nForestry to implement the Oklahoma Registered Poultry\n\nFeeding Operations Act and rules promulgated pursuant\n\nthereto.\n\nThe rules promulgated by the Board pursuant to this section\n\nshall provide for exceptions to the storage requirements for poultry\n\nwaste in emergency situations. Such exceptions shall include, but\n\nnot be limited to, allowing a contract poultry grower to take such\n\nactions as are necessary to meet requirements imposed on a grower by\n\nan integrator. In such situations, growers shall be required to\n\ntake all actions feasible to prevent pollution from stored poultry\n\nwaste.\n\nC. Every poultry feeding operation shall have a Nutrient\n\nManagement Plan which shall include at a minimum:\n\n1. A description of poultry waste handling procedures and\n\navailability of equipment and type of equipment to be used;\n\n2. The calculations and assumptions used for determining land-\n\napplication rates if land application is applicable;\n\n3. All nutrient analysis data for soil and poultry waste\n\ntesting;\n\n4. Legal description and latitude and longitude of lands to be\n\nused by an operation for land application;\n\n5. Land-application rates of poultry waste shall be based on\n\nthe available nitrogen and phosphorous content of the poultry waste\n\nand shall provide controls for runoff and erosion as appropriate for\n\nsite conditions;\n\n6. The procedures documented in the Nutrient Management Plan\n\nshall ensure that the handling and utilization of poultry waste\n\ncomplies with the following requirements:\n\na. adequate poultry waste storage shall be provided\n\nconsistent with rules promulgated by the Oklahoma\n\nDepartment of Agriculture, Food, and Forestry pursuant\n\nto subsection B of this section,\n\nb. poultry waste shall not be applied to land when the\n\nground is saturated or during rainfall events.\n\nPoultry waste shall not be applied to land when the\n\nground is frozen except in conformance with the\n\nNutrient Management Plan,\n\nc. poultry waste shall only be applied to suitable land\n\nat appropriate times and rates. Discharge or runoff\n\nof waste from the application site is evidence that\n\nthe Nutrient Management Plan requires revisions.\n\nTiming and rate of applications shall be based on\n\nassimilation capacity of the soil profile, assuming\n\nusual nutrient losses, expected precipitation, and\n\nsoil conditions, and\n\nd. poultry waste application shall be prohibited on land\n\nsubject to excessive erosion;\nand rates. Discharge or runoff\n\nof waste from the application site is evidence that\n\nthe Nutrient Management Plan requires revisions.\n\nTiming and rate of applications shall be based on\n\nassimilation capacity of the soil profile, assuming\n\nusual nutrient losses, expected precipitation, and\n\nsoil conditions, and\n\nd. poultry waste application shall be prohibited on land\n\nsubject to excessive erosion;\n\n7. Records shall be maintained of all poultry wastes applied on\n\nland owned or controlled by the operator, and sold or given to other\n\npersons:\n\na. if the poultry waste is sold or given to other persons\n\nfor land application or other use, the poultry feeding\n\noperation shall maintain a log of date of removal from\n\nthe poultry feeding operation, name of recipient the\n\npoultry waste is sold or given to, and amount in wet\n\ntons, dry tons or cubic yards of poultry waste removed\n\nfrom the poultry feeding operation, and\n\nb. the poultry feeding operation shall make available to\n\nthe recipient any nutrient sample analysis of the\n\npoultry waste from that year;\n\n8. Any analysis required by the provisions of the Oklahoma\n\nRegistered Poultry Feeding Operations Act or rules promulgated\n\nthereto shall be performed by a qualified environmental testing\n\nlaboratory certified by the Department of Environmental Quality and\n\napproved by the Oklahoma Department of Agriculture, Food, and\n\nForestry; and\n\n9. Such other information deemed necessary by the Oklahoma\n\nDepartment of Agriculture, Food, and Forestry to administer the\n\nprovisions of the Oklahoma Registered Poultry Feeding Operations Act\n\nand rules promulgated pursuant thereto.\n\nD. 1. The Nutrient Management Plan for new or expanding\n\npoultry feeding operations submitted after July 1, 1998, shall be\n\nprepared by the operator or designee of the operator.\n\n2. After the plan is submitted to the Oklahoma Department of\n\nAgriculture, Food, and Forestry for review and approval if the\n\nDepartment determines that a submitted plan needs or requires any\n\ncorrections or modifications, the Department shall return the\n\nNutrient Management Plan to the operator for corrections.\n\n3. For a renewal, if the Department determines the Nutrient\n\nManagement Plan needs or requires corrections or modifications, the\n\nDepartment shall make appropriate corrections, approve the plan, and\n\nnotify the poultry feeding operation of the modifications.\n\nE. 1. Except as otherwise provided in this subsection, a\n\nNutrient Management Plan for every poultry feeding operation shall\n\nbe renewed and an updated plan shall be submitted to the Oklahoma\n\nDepartment of Agriculture, Food, and Forestry every six (6) years\n\nfrom the date the initial or previous plan was submitted.\n\n2. The operator shall have the option to submit the renewed or\n\nupdated plan through the Department’s website or a printable online\n\nform designed by the Department.\n\n3. A current operator may submit a one-page amendment to the\n\nmost recently submitted plan in lieu of a renewal plan through the\n\nDepartment’s website, if applicable. Poultry feeding operations\n\nsubmitting an amendment pursuant to this subsection shall still be\n\nsubject to the soil and poultry waste testing requirements under\n\nsubsections F and G of this section. The amendment shall contain\n\nthe following statements:\n\na. no changes in the Department’s promulgated standards\n\nfor land application of poultry waste have occurred\n\nsince the most recently submitted Nutrient Management\n\nPlan,\n\nb. there has been no change to the number of poultry\n\nhoused since the most recently submitted Nutrient\n\nManagement Plan,\n\nc. there has been no expansion in the poultry feeding\n\noperation since the most recently submitted Nutrient\n\nManagement Plan, and\n\nd. the entirety of the poultry waste is:\n\nhe most recently submitted Nutrient Management\n\nPlan,\n\nb. there has been no change to the number of poultry\n\nhoused since the most recently submitted Nutrient\n\nManagement Plan,\n\nc. there has been no expansion in the poultry feeding\n\noperation since the most recently submitted Nutrient\n\nManagement Plan, and\n\nd. the entirety of the poultry waste is:\n\n(1) removed off-site as provided in the poultry\n\nfeeding operation’s annual report, as required by\n\nsubsection J of this section, and will continue\n\nto be removed off-site for the next six (6)\n\nyears, or\n\n(2) land-applied and will continue to be land-applied\n\nfor the next six (6) years.\n\nF. Every poultry feeding operation located in a non-nutrient-\n\nlimited watershed and non-nutrient-vulnerable groundwaters shall\n\nperform soil testing on each land-application area and poultry waste\n\ntesting at least once every three (3) years to determine:\n\n1. Soil pH and plant-available nutrients including, at a\n\nminimum, nitrogen, phosphorous, and potassium;\n\n2. Poultry waste nutrient concentrations and moisture; and\n\n3. Application rate based upon the Department’s standards for\n\nland application for poultry waste as promulgated by rules.\n\nG. Every poultry feeding operation located in a nutrient-\n\nlimited watershed and nutrient-vulnerable groundwater shall perform\n\nan annual soil test on each land-application area prior to the first\n\napplication of the calendar year. Poultry waste testing shall be\n\nperformed annually prior to the first application of the calendar\n\nyear. Soil and poultry waste testing shall be performed to\n\ndetermine:\n\n1. Soil pH and plant-available nutrients including at least\n\nnitrogen, phosphorous, and potassium;\n\n2. Poultry waste nutrient concentrations and moisture; and\n\n3. Application rate based upon the Department’s standards for\n\nland application of poultry waste as promulgated by rules.\n\nH. 1. Soil and poultry waste analysis data shall be retained\n\nby the poultry feeding operation for a minimum of six (6) years.\n\n2. All soil and poultry waste analysis data shall be dated\n\nprior to land application.\n\nI. 1. Poultry feeding operations shall develop a plan for the\n\ndisposal of carcasses associated with normal mortality.\n\n2. In the event there is an outbreak of a major disease or\n\nother emergency resulting in deaths significantly higher than normal\n\nmortality rates, the Oklahoma Department of Agriculture, Food, and\n\nForestry may approve, in writing, an alternate method of disposal of\n\ncarcasses or the storage of poultry waste during the emergency\n\nperiod.\n\nJ. Every poultry feeding operation shall file by September 1 of\n\neach year an annual report with the Department regarding all poultry\n\nwaste removed from or land-applied by the facility for the period\n\nfrom July 1 of the previous year through June 30 of that year. The\n\nreport shall contain the following information:\n\n1. The date and amount of poultry waste removed from or land-\n\napplied at the facility;\n\n2. The type of poultry waste removed or land-applied, whether a\n\ncake out, full clean out, in-house windrow or compost, poultry waste\n\nstack shed, or other type;\n\n3. The county and, if applicable, the name of the nutrient-\n\nlimited watershed where the poultry waste was produced; and\n\n4. The location where the poultry waste is removed to:\n\na. if land-applied on-site, provide the following:\n\n(1) the date of the land application,\n\n(2) the total amount of poultry waste land-applied in\n\nwet tons, dry tons, or cubic yards,\n\n(3) the name, mailing address, and telephone number\n\nof the poultry waste applicator, and\n\n(4) the number of acres under the control of the\n\npoultry feeding operation for land application of\n\npoultry waste, or\n\nb. if removed off-site, provide the following:\n\n(1) the date of the removal off-site,\n\n(2) the amount of poultry waste removed in wet tons,\n\ndry tons, or cubic yards,\ntons, or cubic yards,\n\n(3) the name, mailing address, and telephone number\n\nof the poultry waste applicator, and\n\n(4) the number of acres under the control of the\n\npoultry feeding operation for land application of\n\npoultry waste, or\n\nb. if removed off-site, provide the following:\n\n(1) the date of the removal off-site,\n\n(2) the amount of poultry waste removed in wet tons,\n\ndry tons, or cubic yards,\n\n(3) the name, mailing address, and telephone number\n\nof the person the poultry waste is sold or\n\ntransferred to,\n\n(4) the name, mailing address, telephone number, and\n\npoultry waste applicator license number of the\n\npoultry waste applicator, if known, and\n\n(5) the name, mailing address, and telephone number\n\nof the hauler of the poultry waste.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3b0d09805f1e926b7aa3fbbaafb2ffedf73d49ab52a761266ce7350f4d77de20","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-10-9.6","next":"us-ok/okla.-stat.-tit.-2-2-10-9.8"},"notice":"GroundRules: Original legal text.
