Stat. tit. 2, § 2-10-9.9","heading":"Designation of poultry feeding operation as concentrated","body":"animal feeding operation – Rules.\n\nA. In addition to the authority of the State Board of\n\nAgriculture to make designations of a concentrated animal feeding\n\noperation pursuant to Section 20-44 of this title, the Board shall\n\nhave the power to designate a poultry feeding operation as a\n\nconcentrated animal feeding operation as defined by Section 20-41 of\n\nthis title subject to the provisions of the Oklahoma Concentrated\n\nAnimal Feeding Operations Act after an administrative determination\n\nthat an operation has violated or is unwilling to comply with any of\n\nthe provisions of the Oklahoma Registered Poultry Feeding Operations\n\nAct, or any rule promulgated pursuant thereto whether or not the\n\nOklahoma Department of Agriculture, Food, and Forestry determines\n\nthe registered poultry feeding operation to be a significant\n\ncontributor of pollution to waters of this state.\n\nB. In order to protect the public health and safety and the\n\nenvironment of this state, the Board, pursuant to the Oklahoma\n\nRegistered Poultry Feeding Operations Act, may require application\n\nfor a concentrated animal feeding operation license to establish and\n\noperate a poultry feeding operation on and after the effective date\n\nof this act to any person or other legal entity which:\n\n1. Is not in substantial compliance with a final agency order\n\nor any final order or judgment of a court of record secured by any\n\nstate or federal agency relating to poultry feeding operations; or\n\n2. Has evidenced a reckless disregard for the protection of the\n\npublic and the environment as demonstrated by a history of\n\nnoncompliance with environmental laws and rules resulting in\n\nendangerment of human health or the environment.\n\nC. Any action taken in regard to the denial, suspension or\n\nrevocation of a license shall be in conformity with the rules of the\n\nBoard governing administrative procedures and with the\n\nAdministrative Procedures Act.\n\nD. The Board shall promulgate rules which will provide a\n\nprocedure whereby any poultry feeding operation which has been\n\ndesignated a concentrated animal feeding operation pursuant to this\n\nsection may have such designation removed. The rules shall require\n\nsatisfactory evidence that such designation is no longer necessary\n\nin order to ensure that the operation will comply with all\n\nprovisions of the Oklahoma Registered Poultry Feeding Operations Act\n\nand will not contribute to pollution of the waters of this state.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"634bf980b025e7b0410bcb12577823ef2c712d86552ceceb293485ca97796589","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-10-9.8a","next":"us-ok/okla.-stat.-tit.-2-2-10-91"},"notice":"GroundRules: Original legal text.
