The Oklahoma Department of Agriculture, Food, and Forestry\n\nshall develop a grant program for the purpose of providing grants to\n\nincorporated municipalities to mitigate extreme purchase costs,\n\nextraordinary costs, or both, incurred by the incorporated\n\nmunicipality's owned or controlled unregulated utility affected by\n\nthe extreme weather event that began February 7, 2021. To qualify\n\nfor a grant, the following requirements shall be met:\n\n1. The incorporated municipality must show proof of extreme\n\npurchase costs, extraordinary costs, or both incurred by the\n\nincorporated municipality's owned or controlled unregulated utility;\n\n2. The population of the incorporated municipality shall be no\n\ngreater than three thousand five hundred (3,500) persons according\n\nto the most recent Federal Decennial Census or most recent annual\n\nestimate of the population by the United States Census Bureau; and\n\n3. The incorporated municipality's owned or controlled\n\nunregulated utility has had no costs mitigated through\n\nsecuritization as provided by Sections 9070 through 9081 of Title 74\n\nof the Oklahoma Statutes.\n\nB. The Department shall promulgate rules necessary for\n\ndetermining the eligibility and priority of applicants for the\n\ngrants. In determining the priority of applicants, the Department\n\nshall consider the implications of the extraordinary costs and\n\nextreme purchase costs regarding the incorporated municipality's\n\nsolvency and the amount of the incorporated municipality's\n\nextraordinary costs and extreme purchase costs on a per capita\n\nbasis.\n\nC. On or before February 1, 2023, the Oklahoma Department of\n\nAgriculture, Food, and Forestry shall provide a report to the\n\nGovernor, President Pro Tempore of the Senate, and the Speaker of\n\nthe House of Representatives that includes the list of\n\nmunicipalities who applied for the grant, the amount requested by\n\neach municipality, municipalities that were awarded grants, the\n\namount of each grant awarded, and any other information the\n\nDepartment determines to be necessary.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d1e9513edf363153a66c1a0645d578ef6962ea0a73d910cf8143ba4b4cc5fca1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-11-12","next":"us-ok/okla.-stat.-tit.-2-2-11-2"},"notice":"GroundRules: Original legal text.
