The State Board of Agriculture shall have the authority to\n\nissue, renew, deny, suspend, and revoke any permit issued according\n\nto the provisions of the Oklahoma Agriculture Biotechnology Act.\n\nB. No person shall maintain a regulated article without a\n\npermit issued by the Board.\n\nC. Any person who has filed Assurances of Compliance with\n\nfederally established guidelines with his or her Institutional\n\nBiosafety Committee and/or applied for regulatory approval from the\n\nappropriate federal agency shall be exempt from the provisions of\n\nthe Oklahoma Agriculture Biotechnology Act.\n\nD. Any person not in compliance with a federal agency shall\n\nprovide the Board with the following information prior to issuance\n\nof a permit pursuant to the Oklahoma Agriculture Biotechnology Act:\n\n1. Name, title, address, telephone number, signature of the\n\nresponsible person, and type of permit requested such as for\n\nimportation, interstate movement, or release into the environment;\n\n2. All scientific, common, and trade names, and all\n\ndesignations necessary to identify the: Donor organism; recipient\n\norganism; vector or vector agents; constituent of each regulated\n\narticle which is a product; and regulated article;\n\n3. Names, addresses, and telephone numbers of the persons who\n\ndeveloped and/or supplied the regulated article;\n\n4. A description of the means of movement, such as mail, common\n\ncarrier, baggage, or if hand-carried, by whom;\n\n5. A description of the anticipated or actual expression of the\n\naltered genetic material in the regulated article and how that\n\nexpression differs from the expression in the nonmodified parental\n\norganism, including but not limited to morphological or structural\n\ncharacteristics, physiological activities and processes, number of\n\ncopies of inserted genetic material, and the physical state of this\n\nmaterial inside the recipient organism, integrated or\n\nextrachromosomal, products and secretions, growth characteristics;\n\n6. A detailed description of the molecular biology of the\n\nsystem, such as donor-recipient-vector, which is or will be used to\n\nproduce the regulated article;\n\n7. Country and locality where the donor organism, recipient\n\norganism, vector or vector agent, and regulated article were\n\ncollected, developed, and produced;\n\n8. A detailed description of the purpose for the introduction\n\nof the regulated article including a detailed description of the\n\nproposed experimental and/or production design;\n\n9. The quantity of the regulated article to be introduced and\n\nproposed schedule and number of introductions;\n\n10. A detailed description of the processes, procedures, and\n\nsafeguards which have been used or will be used in the country of\n\norigin and in the United States to prevent contamination, release,\n\nand dissemination in the production of the: Donor organism;\n\nrecipient organism; vector or vector agent; constituent of each\n\nregulated article which is a product; and regulated article;\n\n11. A detailed description of the intended destination\n\nincluding final and all intermediate destinations, uses, and/or\n\ndistribution of the regulated article, such as greenhouses,\n\nlaboratory, or growth chamber location; field trial location; pilot\n\nproject location; production, propagation, and manufacture location;\n\nproposed sale and distribution location;\n\n12. A detailed description of the proposed procedures,\n\nprocesses, and safeguards which will be used to prevent escape and\n\ndissemination of the regulated article at each of the intended\n\ndestinations;\n\n13. A detailed description of any biological material, for\n\nexample culture medium, or host material accompanying the regulated\n\narticle during movement; and\n\n14. A detailed description of the proposed method of final\n\ndisposition of the regulated article.\n\nE. Any person or their employees who is issued a permit shall\nthe intended\n\ndestinations;\n\n13. A detailed description of any biological material, for\n\nexample culture medium, or host material accompanying the regulated\n\narticle during movement; and\n\n14. A detailed description of the proposed method of final\n\ndisposition of the regulated article.\n\nE. Any person or their employees who is issued a permit shall\n\ncomply with regulations established by the Board as are necessary to\n\nprevent the uncontrolled dissemination and establishment of a\n\nregulated article in the environment.\n\nF. In accordance with the administration of the Oklahoma\n\nAgriculture Biotechnology Act, the Board is given the authority to\n\ncharge the following fee schedule: A fee of One Hundred Dollars\n\n($100.00) shall be charged each person for a permit to develop,\n\nmaintain, manipulate and/or release a regulated article.
