An applicant for a license to engage in business as a scrap\n\nmetal dealer shall provide all of the following information on the\n\nlicense application:\n\n1. If the applicant is an individual, the full name and place\n\nof residence of the applicant;\n\n2. If the applicant is a firm, corporation or other legal\n\nentity, the full name, place of residence, and the position of the\n\nindividual filing the application on behalf of the entity;\n\n3. The business address of the location where the scrap metal\n\ndealer conducts business or will conduct business as a scrap metal\n\ndealer;\n\n4. Legal proof of ownership, lease agreement or contract for\n\nthe business location;\n\n5. Proof of a dedicated telephone line for the business\n\nlocation;\n\n6. Proof of a general liability insurance policy for the\n\nbusiness location;\n\n7. Proof of a current discharge permit issued pursuant to the\n\nprovisions of the Oklahoma Pollutant Discharge Elimination System\n\nAct; and\n\n8. Whether the person has been previously convicted of, or pled\n\nguilty or nolo contendere to, any felony crime that substantially\n\nrelates to scrap metal dealing and poses a reasonable threat to\n\npublic safety.\n\nB. The Department may conduct any reasonable inquiry or\n\ninvestigation relative to the determination of the fitness of the\n\napplicant to be licensed or continue to be licensed including, but\n\nnot limited to, requiring a national criminal history record check\n\nas provided in Section 150.9 of Title 74 of the Oklahoma Statutes.\n\nC. The Department shall charge an application fee in the amount\n\nof One Hundred Dollars ($100.00) for processing an initial\n\napplication for a scrap metal dealer license. The Department shall\n\nalso charge an investigative fee of One Hundred Dollars ($100.00) to\n\nbe used for the purpose of conducting an investigation of the\n\napplicant. All fees shall be nonrefundable.\n\nD. In addition to the application, each applicant shall submit\n\na full set of fingerprints and a photograph with each application\n\nfor an original license. The fingerprints shall be used for a\n\nnational criminal history record check as provided for in subsection\n\nB of this section. The applicant shall be required to pay for\n\nfingerprints, photographs and the national criminal history records\n\ncheck required for licensure and renewals.\n\nE. If the results of the investigation of the applicant show no\n\nprohibition to granting a license, the Department shall issue the\n\nscrap metal dealer license. The scrap metal dealer license shall be\n\nvalid for a period of one (1) year unless otherwise voluntarily\n\nsurrendered, suspended or revoked by the Department.\n\nF. A scrap metal dealer license issued pursuant to the\n\nprovisions of this act is valid for the conduct of business as a\n\nscrap metal dealer only at the location specified in the\n\napplication. A separate scrap metal dealer license shall be\n\nrequired for each location specified in the application form and\n\neach license shall designate the location to which it applies. The\n\nbusiness of the scrap metal dealer shall not be conducted in any\n\nplace other than that designated by the license. The scrap metal\n\ndealer license shall not be transferable.\n\nG. The Department shall deny the license when the applicant\n\nfails to properly complete the application form or if it is\n\ndetermined that the applicant is not eligible to receive a scrap\n\nmetal dealer license.\n\nH. A scrap metal dealer license may be renewed any time within\n\nsixty (60) days prior to the expiration date of the license. To\n\nrenew a scrap metal dealer license, the licensee must first obtain a\n\nrenewal form from the Department. The licensee must complete the\n\nrenewal form and submit a renewal fee in the amount of One Hundred\n\nDollars ($100.00) to the Department. Upon receipt of the renewal\n\napplication and fee, the Department shall conduct a national\nhin\n\nsixty (60) days prior to the expiration date of the license. To\n\nrenew a scrap metal dealer license, the licensee must first obtain a\n\nrenewal form from the Department. The licensee must complete the\n\nrenewal form and submit a renewal fee in the amount of One Hundred\n\nDollars ($100.00) to the Department. Upon receipt of the renewal\n\napplication and fee, the Department shall conduct a national\n\ncriminal history record check and investigate any other records or\n\ninformation deemed by the Department to be relevant to the renewal\n\nof the scrap metal dealer license. If the licensee appears not to\n\nhave any prohibition to renewing the scrap metal dealer license, the\n\nDepartment shall issue the renewed license for a period of one (1)\n\nyear.\n\nI. The Oklahoma Department of Agriculture, Food, and Forestry\n\nshall promulgate rules, procedures and forms governing the\n\napplication and renewal procedures for scrap metal dealer licenses.\n\nJ. As used in this section:\n\n1. \"Substantially relates\" means the nature of criminal conduct\n\nfor which the person was convicted has a direct bearing on the\n\nfitness or ability to perform one or more of the duties or\n\nresponsibilities necessarily related to the occupation; and\n\n2. \"Poses a reasonable threat\" means the nature of criminal\n\nconduct for which the person was convicted involved an act or threat\n\nof harm against another and has a bearing on the fitness or ability\n\nto serve the public or work with others in the occupation.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9e9a1e1e27fbbdeaf8cb7966d92b659bfbc4fa9721e211476a159cdb176e475e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-11-97","next":"us-ok/okla.-stat.-tit.-2-2-11-99"},"notice":"GroundRules: Original legal text.
