Stat. tit. 2, § 2-14-35","heading":"Board - Powers and duties conforming to National","body":"Institute of Standards and Technology Handbook.\n\nThe State Board of Agriculture shall have the following powers\n\nand duties:\n\n1. Maintain traceability of the state standards to the National\n\nInstitute of Standards and Technology and adopt standard weights and\n\nmeasures for products in conformity with federal standards for use\n\nas the standard for weighing and measuring products in Oklahoma;\n\n2. Ensure that all rules conform as nearly as practicable to\n\nthe uniform regulations adopted by the National Conference on\n\nWeights and Measures and published in the National Institute of\n\nStandards and Technology Handbook 130, “Uniform Laws and\n\nRegulations”, including all supplements and revisions thereof;\n\n3. Establish requirements for labeling, for the presentation of\n\ncost-per-unit information, for standards of weight, measure, or\n\ncount, and for standards of fill for any packaged commodity. The\n\nBoard may establish requirements for open dating information;\n\n4. Conduct investigations to ensure compliance with this\n\narticle;\n\n5. Inspect and test weights and measures kept, offered, or\n\nexposed for sale;\n\n6. Inspect and test to ascertain if the weights and measures\n\ncommercially used are correct by:\n\na. determining the weight, measure, or count of\n\ncommodities or things sold, offered, or exposed for\n\nsale on the basis of weight, measure, or count, or\n\nb. by computing the basic charge or payment for services\n\nrendered on the basis of weight, measure, or count;\n\n7. Approve for use weights and measures found to be correct and\n\nreject and mark as rejected weights and measures found to be\n\nincorrect. Approved weights and measures may be marked as approved.\n\nWeights and measures that have been rejected may be seized if not\n\ncorrected within the time specified or if used or disposed of in a\n\nmanner not specifically authorized. The Board shall condemn and may\n\nseize weights and measures found to be incorrect that are not\n\ncapable of being made correct;\n\n8. Weigh, measure, or inspect packaged commodities kept,\n\noffered or exposed for sale, sold or in the process of delivery, to\n\ndetermine whether they contain the amounts represented and are in\n\naccordance with this article and rules of the Board. The Board\n\nshall use recognized sampling procedures adopted by the National\n\nConference on Weights and Measures and published in the National\n\nInstitute of Standards and Technology Handbook 133, “Checking the\n\nNet Contents of Packaged Goods” and supplements and revisions;\n\n9. If a method of declaring the quantity of a specific\n\ncommodity by weight, measure, numerical count, or combination does\n\nnot facilitate value comparisons by consumers or offers an\n\nopportunity for consumer confusion, an appropriate term or unit of\n\nweight or measure may be prescribed;\n\n10. Allow reasonable variations from the stated quantity of\n\ncontents, including but not limited to those caused by loss or gain\n\nof moisture during the course of good distribution practice or by\n\nunavoidable deviations in good manufacturing practice only after the\n\ncommodity has entered intrastate commerce;\n\n11. Set standards for inspection by rule for circumstances not\n\naddressed by the National Institute of Standards and Technology\n\nHandbook 130, “Uniform Laws and Regulations” and the National\n\nInstitute of Standards and Technology Handbook 133, “Checking the\n\nNet Contents of Packaged Goods”;\n\n12. Promulgate rules for the enforcement of the National\n\nInstitute of Standards and Technology Handbook Number 130, “Uniform\n\nLaws and Regulations,” the National Institute of Standards and\n\nTechnology Handbook 133, “Checking the Net Contents of Packaged\n\nGoods, and the act; and\n\n13.
