Within thirty (30) days of the establishment of a fair\n\nassociation, the board of county commissioners shall, by resolution,\n\ncall for an election of the fair association board of directors.\n\nNotice of the elections shall be given in a newspaper published in\n\nthe county at least ten (10) days before election. Notice of the\n\nfiling period for the elections shall be given in a newspaper\n\npublished in the county at least ten (10) days before the filing\n\nperiod for the election. The board of county commissioners, by\n\nresolution, shall set forth the following conditions concerning the\n\nelection:\n\n1. The filing period shall consist of five (5) consecutive\n\nbusiness days;\n\n2. Only registered voters of the county are eligible to file as\n\na candidate;\n\n3. Any person so filing must reside in the commissioner's\n\ndistrict or city they seek to represent;\n\n4. Prospective candidates must file with the county clerk;\n\n5. The board of county commissioners shall prescribe a form to\n\nbe used by prospective candidates filing for the position of\n\ndirector of the fair board association; and\n\n6. The date of the election for the fair association board of\n\ndirectors shall be no later than three (3) weeks from the date of\n\nthe final day of the filing period.\n\nB. If a district or city does not have a candidate or\n\ncandidates for the position, the representative or representatives\n\nshall be appointed as follows:\n\n1. The board of county commissioners shall appoint the\n\nrepresentatives from the rural areas of the county;\n\n2. The mayor of the city shall appoint the representatives from\n\nthe city; and\n\n3. In the event there is not a candidate for election to the\n\nfair association board of directors the appointment will be\n\nannounced no later than two (2) weeks from the closing of the filing\n\nperiod.\n\nC. The site of the elections shall be determined by the board\n\nof county commissioners. Elections shall be held at a convenient\n\nplace in each district or city, on the same day and at the same\n\ntime. The county commissioner representing the district or an\n\nofficial designee of the commissioner shall preside at the election.\n\nD. The election shall be by secret ballot.\n\nE. Only registered voters of the county shall be allowed to\n\nvote.\n\nF. The results of the election shall be tabulated at the site\n\nof the election and announced prior to the adjournment of the\n\nelection meeting.\n\nG. When a tie vote occurs in the election of a fair association\n\nboard of directors, the commissioner or commissioner's designee\n\nshall select the candidate by lot, pursuant to the procedures set\n\nforth in Section 8-105 of Title 26 of the Oklahoma Statutes.\n\nH. Initial terms of the directors:\n\n1. The director from commissioner's district one shall be\n\nelected for a term of one (1) year;\n\n2. The director from commissioner's district two shall be\n\nelected for a term of two (2) years; and\n\n3. The director from commissioner's district three shall be\n\nelected for a term of three (3) years.\n\nThe term of each director elected subsequent to the initial term\n\nshall be for a period of three (3) years.\n\nI. If there is a city in the county with a population of more\n\nthan twenty thousand (20,000) according to the latest federal\n\ncensus, the board of county commissioners shall in the following\n\nmanner cause to be elected two directors to represent the city on\n\nthe fair association board of directors:\n\n1. The county clerk or an official designee of the clerk shall\n\npreside at election in the city;\n\n2. The candidate receiving the highest number of the ballots\n\ncast shall be elected for a three-year term;\n\n3. The candidate receiving the second highest number of votes\n\nshall be elected for a two-year term; and\n\n4. If, by the close of the filing period, a district or city is\n\nwithout a candidate for the position of fair board director, the\nee of the clerk shall\n\npreside at election in the city;\n\n2. The candidate receiving the highest number of the ballots\n\ncast shall be elected for a three-year term;\n\n3. The candidate receiving the second highest number of votes\n\nshall be elected for a two-year term; and\n\n4. If, by the close of the filing period, a district or city is\n\nwithout a candidate for the position of fair board director, the\n\nboard of county commissioners shall appoint a person to serve on the\n\nfair association board of directors to represent the respective\n\ndistrict and the mayor of the city shall make the appointments for\n\nthe two city representatives.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"49ae030fe281ff4b2312a9e28702947da6493265ab0d1b114d25873286cd14b3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-15-112","next":"us-ok/okla.-stat.-tit.-2-2-15-114"},"notice":"GroundRules: Original legal text.
