There is hereby constituted a board of directors for the\n\nfree fair association.\n\nB. 1. The board of directors shall be composed of nine (9)\n\nmembers, who shall be by written ballot elected for a term of three\n\n(3) years. Three members shall be elected annually, one from each\n\ncounty commissioner's district of the counties, at a public meeting\n\nor convention of the qualified electors of each commissioner's\n\ndistrict in the counties.\n\n2. A qualified elector shall be a registered voter of the\n\ncounty and may only vote for the board members from the district in\n\nwhich the elector resides. The county commissioner holding the\n\nelection may request proof of residency and a voter registration\n\ncard of the county to qualify electors.\n\n3. The board of county commissioners shall include in the\n\npublication notice of the election the requirements to be a\n\nqualified voter. Notice of the election shall be given by\n\npublication in a newspaper published in each of the counties for ten\n\n(10) days before the election. Notice of the filing period for the\n\nelection shall be given in a newspaper published in the county,\n\npublished one time at least ten (10) days before the filing period\n\nfor the election.\n\nC. The board of county commissioners shall, by resolution, set\n\nforth the following conditions concerning the election:\n\n1. The filing period shall consist of five (5) consecutive\n\nbusiness days and commence in January;\n\n2. The date and time the filing period will commence and end;\n\n3. The date, time and place of the election;\n\n4. Only registered voters of the county are eligible to file as\n\na candidate;\n\n5. Any person so filing must reside in the commissioner's\n\ndistrict or city they seek to represent;\n\n6. Prospective candidates must file with the county clerk; and\n\n7. The board of county commissioners shall prescribe a form to\n\nbe used by prospective candidates filing for the position of\n\ndirector of the fair association board.\n\nD. 1. The date of the election for the fair association board\n\nof directors shall be no later than three (3) weeks from the date of\n\nthe final day of the filing period. If there is only one candidate\n\nfor any of the commissioners' districts, the commissioners may\n\ncancel the election with notice being given by publication and\n\nposting at least ten (10) days prior to the election date previously\n\nestablished and the candidate shall be deemed to be elected.\n\n2. In the event there is no candidate for the election to the\n\nfair association board of directors, the county commissioners shall\n\nappoint a director for each position for which no candidates have\n\nfiled by the close of the filing period. The appointment or\n\nappointments will be announced no later than two (2) weeks from the\n\nclosing of the filing period.\n\n3. When a director is unable to fulfill the term to which the\n\ndirector has been elected to serve, for any reason, the board of\n\ncounty commissioners shall appoint the successor.\n\nE. 1. At the annual election there shall be elected one (1)\n\nperson from each commissioner's district who is a qualified elector\n\nof the district. Each shall serve as a director of the association\n\nfor a term of three (3) years, and until a successor is elected or\n\nappointed and qualified.\n\n2. The commissioner or commissioner's designee shall preside at\n\nthe meeting and have the authority to appoint a secretary of the\n\nmeeting. The commissioner and secretary shall certify to the county\n\nclerk of each of the counties the names of the directors elected,\n\nand the county clerk shall keep a record thereof and shall issue to\n\neach person elected a certificate of election.\n\nF. When a tie vote occurs in the election of a fair association\n\nboard of directors, the commissioner or commissioner's designee\n\nshall select the candidate by lot pursuant to the procedures set\n\nforth in Section 8-105 of Title 26 of the Oklahoma Statutes.\n\nG. 1. The directors so elected shall meet at the next\neep a record thereof and shall issue to\n\neach person elected a certificate of election.\n\nF. When a tie vote occurs in the election of a fair association\n\nboard of directors, the commissioner or commissioner's designee\n\nshall select the candidate by lot pursuant to the procedures set\n\nforth in Section 8-105 of Title 26 of the Oklahoma Statutes.\n\nG. 1. The directors so elected shall meet at the next\n\nregularly scheduled monthly meeting immediately following the\n\nelections at the regular meeting place of the counties for the\n\npurpose of organization, and shall elect a president, a vice-\n\npresident, a secretary and a treasurer; provided, that the secretary\n\nneed not be a member of the board of directors.\n\n2. The treasurer shall furnish a surety bond executed with a\n\nqualified surety company doing business in this state, in such\n\namount as the directors of the board may determine to be necessary\n\nto indemnify against any loss which may arise by reason of failure\n\nto perform the necessary duties of the office or other misconduct in\n\noffice for which the director shall be held liable.\n\nH. Meetings of the directors may be called by the president of\n\nthe board or fixed by the board at any time convenient.
