Stat. tit. 2, § 2-16-40","heading":"Actions for damages - Pleading and proof of title to","body":"realty unnecessary – Railroads’ liability for damages by fire.\n\nIn any action instituted in any court to recover damages under\n\nthe provisions of the Oklahoma Forestry Code, it shall not be\n\nnecessary for any person, injured by any fire to allege in pleadings\n\nor prove on trial title to the real property over which the fire has\n\nspread, but it shall be sufficient in any action to allege and prove\n\nthat the person injured was in the occupancy or possession of any\n\nranch, buildings, improvements, hay, grass, crops, fencing, timber,\n\nmarsh, or other property, claiming the right to and occupying with\n\ncattle any cattle range; it being the purpose and intention of this\n\ncode to protect the possession of any person whether the person has\n\ntitle to the land claimed or occupied or not.
