It shall be unlawful for any person willingly, knowingly, or\n\nfraudulently to represent, make, issue, deliver, use or submit, or\n\nto participate in representing, making, issuing, delivering, using,\n\nor submitting any fictitious, false or fraudulent offer, agreement,\n\ncontract, or other instrument concerning:\n\n1. The sale of timber or the right to cut or harvest or remove\n\ntimber from a site or from real property not owned or leased by that\n\nperson; or\n\n2. The sale of timber or the right to cut or harvest or remove\n\ntimber that is not owned by that person.\n\nB. It shall be unlawful for a timber owner to, knowingly or\n\nwith intent to defraud, fail to pay in a timely manner the\n\napplicable owners the full price of all the purchased timber.\n\n1. A timber owner acts with intent to defraud if the timber\n\nowner disperses, uses, or diverts money with the intent to deprive\n\nan owner of the purchase money.\n\n2. Unless otherwise agreed to in writing, a timber owner is\n\npresumed to have acted with intent to defraud if the timber owner\n\ndoes not pay all applicable owners for the purchase price of the\n\ntimber not later than forty-five (45) calendar days after the date\n\nthe timber owner collects money for the timber.\n\nC. Any person convicted of violating the provisions of this\n\nsection shall be guilty of:\n\n1. A Class D3 felony offense if the timber to be sold or right\n\nto cut or harvest the timber pursuant to subsection A of this\n\nsection is valued at more than Two Hundred Dollars ($200.00). Upon\n\nconviction the person shall be subject to the imposition of a fine\n\nof not more than Ten Thousand Dollars ($10,000.00), or by\n\nimprisonment as provided for in subsections B through F of Section\n\n20P of Title 21 of the Oklahoma Statutes, or to both; or\n\n2. A misdemeanor if the timber to be sold or right to cut or\n\nharvest the timber pursuant to subsection A of this section is\n\nvalued at Two Hundred Dollars ($200.00) or less.
