Stat. tit. 2, § 2-16-65","heading":"Evidence of ownership to be required by timber","body":"purchasers.\n\nA. 1. Except as provided by this section, it shall be the duty\n\nof any sawmill owner or operator or other person purchasing timber\n\nfor resale, from a timber owner or owner or operator of a logging or\n\ntimber harvesting operation to obtain from the timber owner or owner\n\nor operator of a logging or timber harvesting operation a bill of\n\nsale for the same or other evidence of ownership which shall be\n\npreserved by the purchaser for a period of three (3) years and shall\n\nbe available for inspection by law enforcement personnel.\n\n2. The bill of sale shall include:\n\na. the name and address of the seller and purchaser,\n\nb. a legal description of the land from which the timber\n\nwas harvested,\n\nc. a description of timber delivered,\n\nd. the date delivered,\n\ne. the printed name of the person delivering the timber,\n\nand\n\nf. the date and signature of the person delivering the\n\ntimber with language declaring ownership of the timber\n\nor naming the person to whom the person delivering the\n\ntimber is an agent.\n\nB. In lieu of the bill of sale required by subsection A of this\n\nsection, the purchaser may provide for proof of timber ownership\n\nthrough a written purchase contract which provides language\n\ndeclaring ownership of timber delivered for purchase to the\n\npurchaser by the timber owner. The declaration shall be signed by\n\nthe timber owner or by a designee pursuant to a written\n\nauthorization signed by the timber owner.
