There is hereby assessed a fee of one cent ($0.01) per\n\nbushel upon all sorghum marketed by sorghum producers in this state\n\nand sold or handled through commercial channels. The fee shall be\n\nassessed and imposed upon the sorghum producer at the time of sale\n\nor delivery and shall be collected and remitted by the first\n\npurchaser to the Commission. Pursuant to the provisions of the\n\nOklahoma Sorghum Resources Act, no sorghum shall be subject to\n\nassessment of a fee more than once.\n\n2. No assessments for sorghum shall be collected in accordance\n\nwith this section while a national checkoff program for sorghum\n\nestablished pursuant to 7 CFR 1221 remains in effect. The\n\ncollection of assessments in accordance with this section shall be\n\nreinstated upon suspension or termination of the program for sorghum\n\nestablished pursuant to 7 CFR 1221.\n\nB. 1. The first purchaser shall collect the assessment by\n\ndeducting the appropriate amount from the purchase price of the\n\nsorghum or from any funds advanced for that purpose.\n\n2. The Commission, by registered or certified mail, shall\n\nnotify each first purchaser of the duty to collect the assessment,\n\nthe manner in which the assessment is to be collected, and the date\n\non or after which the first purchaser is to begin collecting the\n\nassessment.\n\n3. The amount of the assessment collected shall be clearly\n\nshown on the sales invoice or other document evidencing the\n\ntransaction. The first purchaser shall furnish a copy of the\n\ndocument to the sorghum producer.\n\n4. The Commission shall establish through bylaws the procedures\n\nfor the collection and remittance of the assessment.\n\nC.
