Oilseed producers may petition for a referendum to determine\n\nif the assessment is to be continued at any time. The President of\n\nthe State Board of Agriculture shall call and conduct a referendum\n\nif the petitions bear signatures of ten percent (10%) of the oilseed\n\nproducers. No more than one referendum shall be conducted in any\n\none thirty-six-month period. The Oklahoma Department of\n\nAgriculture, Food, and Forestry shall determine if the petition\n\nbears the required number of valid signatures. The President shall\n\nannounce the referendum at least thirty (30) days prior to the day\n\nof voting. At least thirty (30) days before the referendum, the\n\nDepartment shall mail a notice of the referendum to all known\n\noilseed producers in the State of Oklahoma who market oilseed in\n\ncommercial quantities. The notice shall specify the dates, times,\n\nand places for holding the referendum, and shall include a sample\n\nballot with the following wording:\n\nDO YOU FAVOR A CONTINUATION OF THE THREE CENTS ($0.03) PER\n\nHUNDREDWEIGHT (CWT) ASSESSMENT ON OILSEED MARKETED IN OKLAHOMA\n\nFOR UTILIZATION, RESEARCH, EDUCATION, PROMOTION, AND MARKET\n\nDEVELOPMENT?\n\nYES ( ) NO ( )\n\nB. Places within each county for conducting the referendum\n\nshall be designated by the Agricultural Extension Division of\n\nOklahoma State University, and voting in each county shall be\n\nsupervised by the county agricultural extension agent, or person\n\ndesignated by the Department. The Oklahoma Oilseed Commission shall\n\nensure sufficient ballots and supplies necessary for the conduct of\n\nthe voting and tabulation of returns. Certified results of the\n\nreferendum in each district shall be transmitted within twenty-four\n\n(24) hours after voting ends to the President, and the ballots shall\n\nbe transmitted to the President within forty-eight (48) hours.\n\nBallots shall be preserved by the President for a period of at least\n\nthree (3) months.\n\nC. 1. The results of the referendum shall be determined by the\n\nPresident, and the results certified to the Governor who shall issue\n\na proclamation declaring the results.\n\n2. The Commission shall bear expenses of advertising and\n\nconducting the referendum.\n\nD.
