Producers may petition for a referendum at any time after\n\nfive (5) years following the effective date of the Oklahoma Wheat\n\nResources Act to determine if the assessment is to be continued.\n\nB. The President of the State Board of Agriculture shall call\n\nand conduct a referendum if the petitions bear signatures of ten\n\npercent (10%) of the wheat producers. No more than one such\n\nreferendum shall be conducted in any one thirty-six-month period.\n\nThe State Board of Agriculture shall determine if the petition bears\n\nthe required number of valid signatures. The President shall\n\nannounce the referendum at least thirty (30) days prior to the day\n\nof voting. At least thirty (30) days before the referendum, the\n\nPresident shall mail a notice of the referendum to all known wheat\n\nproducers in the State of Oklahoma who market wheat in commercial\n\nquantities. The notice shall specify the dates, times, and places\n\nfor holding the referendum. The notice shall also include a sample\n\nballot with the following wording:\n\nDO YOU FAVOR A CONTINUATION OF THE FEE ASSESSMENT ON WHEAT\n\nMARKETED IN OKLAHOMA FOR UTILIZATION, RESEARCH AND MARKET\n\nDEVELOPMENT?\n\nYES ( ) NO ( )\n\nC. Places within each county for conducting the referendum\n\nshall be designated by the Agricultural Extension Division of\n\nOklahoma State University. Voting in each county shall be\n\nsupervised by the county agricultural extension agent, or a person\n\ndesignated by the Extension Division in cases where there is no\n\ncounty agent in a county at the time of the referendum.\n\nD. The Oklahoma Wheat Commission shall ensure sufficient\n\nballots and supplies necessary for conducting the voting and the\n\ntabulation of returns.\n\nE. Certified results of the referendum in each county shall be\n\ntransmitted within twenty-four (24) hours after voting ends to the\n\nPresident of the State Board of Agriculture. The ballots shall be\n\ntransmitted to the President within forty-eight (48) hours. Ballots\n\nshall be preserved by the President for a period of at least three\n\n(3) months.\n\nF. The results of the referendum shall be determined by the\n\nPresident and the results certified to the Governor, who shall issue\n\na proclamation declaring the results.\n\nG. The Commission shall bear expenses of advertising and\n\nconducting the referendum.\n\nH. Whenever the question of levying the assessments is\n\ndisapproved, by failure of sixty percent (60%) of the producers\n\nvoting in the referendum to favor continuation of the assessments,\n\nthe proclamation declaring the result shall provide for the\n\ntermination of the assessments on April 30, following the date of\n\nthe referendum.\n\nI.
