There is hereby created, to continue until July 1, 2010, in\n\naccordance with the provisions of the Oklahoma Sunset Law, the\n\nOklahoma Beef Council.\n\nB. The Oklahoma Beef Council shall:\n\n1. Promote the sale and use of beef and beef products, support\n\nnational beef promotion, research, education, and other consumer\n\nmarketing activities related to beef and cattle production, and\n\notherwise support consumer market development and promotion efforts\n\non a national and international scale;\n\n2. Develop new uses and markets for beef and beef products;\n\n3. Develop and improve methods of distributing beef and beef\n\nproducts to the consumer;\n\n4. Develop methods of improving the quality and safety of beef\n\nand beef products for consumer benefit;\n\n5. Inform and educate the public of the nutritive, safety, and\n\neconomic values of beef and beef products;\n\n6. Function in a liaison capacity with the beef and other food\n\nindustries of the state and elsewhere in matters that would increase\n\nefficiencies ultimately benefiting the consumer and the industry;\n\n7. Receive and disburse funds for use in administering and\n\nimplementing the provisions and intent of the Oklahoma Beef\n\nImprovement and Market Development Act;\n\n8. Annually elect a chairperson from among its members who may\n\nbe reelected for not more than one one-year term;\n\n9. Meet regularly, but in no case shall meet less than one time\n\nper calendar quarter, at any other times as called by the Chair, or\n\nupon request by three or more members of the Council;\n\n10. Maintain a permanent record of all business proceedings;\n\n11. Maintain a permanent and detailed record of all financial\n\ndealings;\n\n12. Prepare periodic reports and an annual report of all\n\nactivities for each fiscal year, for review by the beef cattle\n\nindustry of the state. The annual report shall be filed with the\n\nChair of the Senate Agriculture and Rural Development Committee or\n\nsuccessor committee, the Chair of the House Agriculture Committee or\n\nsuccessor committee, the Commissioner of the Oklahoma Department of\n\nAgriculture, Food, and Forestry, and the Governor;\n\n13. Prepare periodic reports and an annual accounting for each\n\nfiscal year of all receipts and expenditures for review of the beef\n\ncattle industry of the state and provide for annual audits conducted\n\nby a certified public accounting firm;\n\n14. Adopt and promulgate rules pursuant to the Administrative\n\nProcedures Act, with the assistance of the Oklahoma Department of\n\nAgriculture, Food, and Forestry if requested by the Council, for\n\nimplementation of the Oklahoma Beef Improvement and Market\n\nDevelopment Act;\n\n15. Maintain an office at a specific location in Oklahoma that\n\nis accessible to beef producers and conducive to operating the\n\nprograms of the Council; and\n\n16. Have such other powers and duties to implement the Oklahoma\n\nBeef Improvement and Market Development Act.\n\nC. The Council may:\n\n1. Conduct or contract for scientific research with any\n\naccredited university, college, or similar institution and enter\n\ninto other contracts or agreements that aid in carrying out the\n\npurposes of the Oklahoma Beef Improvement and Market Development\n\nAct, including, but not limited to, contracts for the purchase or\n\nacquisition of facilities, advertising, or equipment;\n\n2. Disseminate reliable information benefiting consumers and\n\nthe beef cattle industry on subjects including, but not limited to,\n\npurchase, identification, care, storage, handling, cookery,\n\npreparation, serving size or portion, and nutritional value of beef\n\nand beef products;\n\n3. Provide information to various governmental bodies, upon\n\nrequest, on subjects of concern to the beef industry and act jointly\n\nor in cooperation with the state or federal government, and agencies\n\nthereof, in the development or administration of programs deemed by\n\nthe Council as consistent with the objectives of the Oklahoma Beef\n\nImprovement and Market Development Act;\nf\n\nand beef products;\n\n3. Provide information to various governmental bodies, upon\n\nrequest, on subjects of concern to the beef industry and act jointly\n\nor in cooperation with the state or federal government, and agencies\n\nthereof, in the development or administration of programs deemed by\n\nthe Council as consistent with the objectives of the Oklahoma Beef\n\nImprovement and Market Development Act;\n\n4. Cause any civil action to be filed to enforce the provisions\n\nof the Oklahoma Beef Improvement and Market Development Act;\n\n5. Appoint advisory groups composed of representatives from\n\norganizations, institutions, governments, or business related to or\n\ninterested in the welfare of the beef industry and the consuming\n\npublic;\n\n6. Employ an Executive Director and employees of the Council\n\nand prescribe their duties and fix their compensation and terms of\n\nemployment;\n\n7. Cooperate with any local, state, regional or nationwide\n\norganization or agency engaged in work or activities consistent with\n\nthe objectives of the Oklahoma Beef Improvement and Market\n\nDevelopment Act; and\n\n8. Cause any duly authorized agent or representative of the\n\nCouncil to enter upon the premises of any market agent with proper\n\nwarrants and examine or require examination of only those books,\n\npapers, and records associated in any way with payments of\n\nassessments or enforcement of the Oklahoma Beef Improvement and\n\nMarket Development Act. It shall be incumbent upon the Council to\n\nmake appropriate arrangements with the persons being examined to\n\nensure that an orderly examination is made that does not impede on\n\nthe person's normal course of business.\n\nD.
