Any producer who has paid the assessment under the\n\nprovisions of the Oklahoma Beef Improvement and Market Development\n\nAct shall be entitled to a refund upon a valid request to the\n\nCouncil.\n\nB. The Council shall make available to all producers and\n\nmarketing agents forms for refund requests.\n\nC. Refund claims shall be submitted by the producer within\n\nforty-five (45) days of the payment of the assessment and shall\n\ninclude a signature, date of sale, place of sale, number of cattle,\n\namount of assessment deducted, and proof of the payment of the\n\ndeducted assessment.\n\nD. 1. Upon verification of a valid refund request, the Council\n\nshall remit a refund to the producer within forty-five (45) days of\n\nthe valid request.\n\n2. In the event the Council fails to remit the valid requested\n\nrefund as required by this subsection, the producer may bring a\n\ncivil action against the Council in the district court of the county\n\nin which the office of the Council is located for collection of the\n\nrefund, a ten-percent-penalty assessment, and all court costs.\n\n3. The civil action shall be tried and judgment rendered as in\n\nany other cause of action for debts due and payable.\n\n4. All assessments, penalty assessments, and enforcement costs\n\nrecovered are due and payable to the producer.\n\nE. If the Council has reasonable doubt that a refund claim is\n\nvalid, it may withhold payment and take action as deemed necessary\n\nto determine its validity.\n\nF.
