Before any change in assessment can be made, a referendum of\n\nOklahoma peanut growers shall be conducted to determine the\n\nproportion of the peanut growers that favor continuation of the\n\nprogram and the proportion of peanut growers that favor\n\ndiscontinuing the program. Thereafter, such referendum shall be\n\nconducted no more than once every three (3) years upon the receipt\n\nby the Oklahoma Peanut Commission of petitions requesting a\n\nreferendum signed by at least ten percent (10%) of Oklahoma peanut\n\ngrowers.\n\nB. At any time a referendum is to be held, the Commission shall\n\nwrite a definition of a producer eligible to vote, and shall cause a\n\nnotice to be given, by letter or publication in the official\n\npublication of the Oklahoma Peanut Commission. The Commission shall\n\nsend ballots to those persons eligible to vote and shall set the\n\nfinal date for ballots to be returned for tabulation. The\n\nCommission shall provide for the printing of ballots and shall\n\nfurnish a double envelope system so that the identity of a voter\n\ncannot be determined. The grower shall return the ballots by way of\n\na sealed envelope, pre-addressed to the President of the State Board\n\nof Agriculture.\n\nC. Tabulation of ballots shall be jointly by the President of\n\nthe State Board of Agriculture and chairman of the Oklahoma Peanut\n\nCommission. Whenever the question of levying the assessments is\n\ndisapproved, by failure of sixty percent (60%) of growers voting in\n\nthe referendum to favor continuation of the assessments, the\n\nproclamation declaring the result shall provide for the termination\n\nof the assessments on April 30, following the date of the\n\nreferendum.\n\nD.
