After notice and opportunity for a hearing in accordance\n\nwith the Administrative Procedures Act, if the State Board of\n\nAgriculture finds any person in violation of the Oklahoma\n\nAgricultural Code or any rule promulgated or order issued pursuant\n\nthereto, the Board shall have the authority to assess an\n\nadministrative penalty of not less than One Hundred Dollars\n\n($100.00) and not more than Ten Thousand Dollars ($10,000.00) for\n\neach violation. Each animal, each action, or each day a violation\n\ncontinues may constitute a separate and distinct violation.\n\nB. The Board may appoint administrative law judges to conduct\n\nthe hearings. Hearings shall be held at a location within the\n\nregion in which the alleged violator resides or the violation\n\noccurred, or the central offices of the State Board of Agriculture\n\nin Oklahoma City, Oklahoma.\n\nC. Any person who fails to comply with the provisions of the\n\nOklahoma Agricultural Code or rules promulgated by the Board shall\n\nbe deemed guilty of a misdemeanor unless a violation of the Oklahoma\n\nAgricultural Code or rules promulgated thereto is specifically\n\nidentified with a penalty or as a Class D3 felony offense in the\n\nindividual articles of the Oklahoma Agricultural Code. Any person\n\nwho violates the provisions of this subsection shall, upon\n\nconviction, be guilty of a Class D3 felony offense and shall be\n\npunished by imprisonment as provided for in subsections B through F\n\nof Section 20P of Title 21 of the Oklahoma Statutes.\n\nD. Nothing in the Oklahoma Agricultural Code shall preclude the\n\nBoard from seeking penalties in district court in the maximum amount\n\nallowed by law. The assessment of penalties in an administrative\n\nenforcement proceeding shall not prevent the subsequent assessment\n\nby a court of the maximum civil or criminal penalties for violations\n\nof the Oklahoma Agricultural Code and rules promulgated pursuant\n\nthereto.\n\nE.
