Any individual entering through gates used for ingress or\n\negress to a property designated as an easement shall maintain the\n\nposition of the gate upon use.\n\nB. 1. Any individual who violates the provisions of subsection\n\nA of this section shall, upon conviction, be guilty of a misdemeanor\n\npunishable by a fine not more than Five Hundred Dollars ($500.00),\n\nby imprisonment in a county jail for not more than ninety (90) days,\n\nor by both such fine and imprisonment.\n\n2. Any individual convicted of a second offense shall, upon\n\nconviction, be guilty of a misdemeanor punishable by a fine not more\n\nthan One Thousand Dollars ($1,000.00), by imprisonment in a county\n\njail for not more than one hundred eighty (180) days, or by both\n\nsuch fine and imprisonment.\n\n3. Any individual convicted of a third or subsequent offense\n\nshall, upon conviction, be punished by a fine not more than One\n\nThousand Five Hundred Dollars ($1,500.00), by imprisonment in a\n\ncounty jail for not more than one (1) year, or by both such fine and\n\nimprisonment.\n\n4. Any individual convicted pursuant to the provisions of this\n\nsubsection shall also be liable for damages.\n\nC.
