It shall be unlawful for any person to operate a\n\nconcentrated swine feeding operation, without first obtaining a\n\nlicense from the State Board of Agriculture.\n\n2. The owner or operator of a swine feeding operation not\n\nclassified as a concentrated swine feeding operation may apply for a\n\nlicense if the owner or operator elects to come under the provision\n\nof the Oklahoma Swine Feeding Operations Act and the rules of the\n\nState Board of Agriculture.\n\n3. The owner or operator of a swine feeding operation primarily\n\nusing a liquid swine waste management system not classified as a\n\nlicensed managed feeding operation may apply for a license if the\n\nowner or operator voluntarily elects to come under the provisions of\n\nthe Oklahoma Swine Feeding Operations Act relating to licensed\n\nmanaged feeding operations and the rules of the State Board of\n\nAgriculture.\n\nB. 1. The Department of Environmental Quality shall have\n\nenvironmental jurisdiction over:\n\na. commercial manufacturers of fertilizers, grain and\n\nfeed products, and chemicals, and over manufacturing\n\nof food and kindred products, tobacco, paper, lumber,\n\nwood, textile mill and other agricultural products,\n\nb. slaughterhouses, but not including feedlots at these\n\nfacilities, and\n\nc. aquaculture and fish hatcheries, including, but not\n\nlimited to, discharges of pollutants and storm water\n\nto waters of the state, surface impoundments and land\n\napplication of wastes and sludge, and other pollution\n\noriginating at these facilities.\n\n2.
