Licenses shall expire on June 30 of each year and may be\n\nrenewed upon payment of the license and swine animal unit fees set\n\nforth in this section and continued compliance with the provisions\n\nof the Oklahoma Swine Feeding Operations Act and the rules of the\n\nBoard.\n\nB. The fees for a swine feeding operations license and annual\n\nrenewal thereof shall be:\n\n1. Fifteen Dollars ($15.00) for facilities with a capacity of\n\nless than two hundred fifty (250) swine animal units;\n\n2. Thirty-seven Dollars and fifty cents ($37.50) for facilities\n\nwith a capacity of two hundred fifty (250) to five hundred (500)\n\nswine animal units;\n\n3. Seventy-five Dollars ($75.00) for facilities with a capacity\n\nof five hundred one (501) to three thousand (3,000) swine animal\n\nunits;\n\n4. One Hundred Fifty Dollars ($150.00) for facilities with a\n\ncapacity of three thousand one (3,001) to ten thousand (10,000)\n\nswine animal units; or\n\n5. Two Hundred Twenty-five Dollars ($225.00) for facilities\n\nwith a capacity of more than ten thousand (10,000) swine animal\n\nunits.\n\nC. 1. All licensed managed feeding operations shall pay an\n\nadditional license fee for original licenses in an amount equal to\n\neighty cents ($0.80) per licensed swine animal unit capacity. One-\n\nhalf (1/2) of the amount shall be due and payable with the\n\napplication.\n\n2. The other one-half (1/2) of the amount shall be due thirty\n\n(30) days from the date the application is approved. In the event\n\nthe application is not approved, any amount of the fee in excess of\n\nthe costs of processing the application shall be refunded to the\n\napplicant.\n\n3. All licensed managed feeding operations shall pay an\n\nadditional license fee for renewal licenses in an amount established\n\nby rules.\n\nD. The Department shall review costs related to the\n\nadministration, regulation, and enforcement of licensed managed\n\nfeeding operations. Based on the review, rules shall be promulgated\n\npursuant to the Administrative Procedures Act establishing a renewal\n\nfee for licensed managed feeding operations. The fee shall be based\n\non the costs incurred by the Department in salaries, travel claims,\n\nand other necessary expenses incurred in fulfilling its regulatory\n\nand administrative obligations with regard to licensed managed\n\nfeeding operations. Under no circumstances shall the fee exceed\n\neighty cents ($0.80) per swine animal unit.\n\nE.
