In addition to any other requirement of the Oklahoma Swine\n\nFeeding Operations Act, swine feeding operations owners and\n\noperators who are granted a swine feeding operations license shall:\n\n1. Provide adequate veterinarian services for detection,\n\ncontrol, and elimination of livestock diseases;\n\n2. Have available for use at all necessary times mechanical\n\nmeans of scraping, cleaning, and grading feed yards premises; and\n\n3. Provide weather resistant aprons adjacent to all permanently\n\naffixed feed bunks, water tanks, and feeding devices.\n\nB. 1. Any swine feeding operation licensed pursuant to the\n\nOklahoma Swine Feeding Operations Act, operated in compliance with\n\nthose standards, and in compliance with the rules promulgated by the\n\nState Board of Agriculture, shall be deemed to be prima facie\n\nevidence that a nuisance does not exist; provided, no swine feeding\n\noperation shall be located or operated in violation of any zoning\n\nregulations.\n\n2. Any swine feeding operation licensed pursuant to the\n\nOklahoma Swine Feeding Operations Act, operated in compliance with\n\nthose standards, and in compliance with rules promulgated by the\n\nBoard, that is located on land more than three (3) miles outside the\n\nincorporated limits of any municipality and which is not located\n\nwithin one (1) mile of ten or more occupied residences shall not be\n\ndeemed a nuisance unless it is shown by a preponderance of the\n\nevidence that the operation endangers the health or safety of\n\nothers.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c4053802a14c1c743703b6cfe4a0a864ed552142d5edd8abba7e4ec45e5ec931","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-20-17","next":"us-ok/okla.-stat.-tit.-2-2-20-19"},"notice":"GroundRules: Original legal text.
