Except as authorized by this subsection, no liquid swine\n\nwaste shall be land applied within five hundred (500) feet of the\n\nnearest corner of an occupied residence not owned or leased by the\n\nowner of the swine feeding operation.\n\nB. Except as otherwise provided by Section 20-20 of this title,\n\nno concentrated swine feeding operation shall be established within\n\none (1) mile of ten or more residences that are occupied residences\n\nat the time of the establishment of the concentrated swine feeding\n\noperation.\n\nC. The proscription contained in subsections A and B of this\n\nsection shall not apply if the applicable property owner executes a\n\nwritten waiver with the owner or operator of the swine feeding\n\noperation, under the terms and conditions that the parties\n\nnegotiate. The written waiver becomes effective upon recording of\n\nthe waiver in the offices of the recorder of deeds in the county\n\nwhere the property is located. The filed waiver shall preclude\n\nenforcement of the setback requirements contained in subsections A\n\nand B of this section. A change in ownership of the applicable\n\nproperty or change in the ownership of the property on which the\n\nswine feeding operation is located shall not affect the validity of\n\nthe waiver.\n\nD. No liquid swine waste shall be land applied within three\n\nhundred (300) feet of an existing public or private drinking water\n\nwell.\n\nE. Except as provided by Section 20-20 of this title, no\n\nconcentrated swine feeding operation shall be established if\n\nlocated:\n\n1. Within three (3) miles of a state park or resort;\n\n2. On land within three (3) miles of the incorporated limits of\n\nany municipality, unless the municipality's governing body executes\n\na written waiver of the setback for the particular swine feeding\n\noperation. A change in ownership of the property on which the\n\nanimal feeding operation is located shall not affect the validity of\n\nthe waiver; or\n\n3. Within three (3) miles of the high water mark of a surface\n\npublic water supply if the concentrated swine feeding operation is\n\nlocated within the drainage basin for the public water supply.\n\nF. All distances between occupied residences and swine feeding\n\noperations shall be measured from the closest corner of the walls of\n\nthe occupied residence to the closest point of the nearest waste\n\nfacility, as determined by the Department.
