A concentrated swine feeding operation may exceed its swine\n\nanimal unit capacity if:\n\n1. A diseased or potentially diseased swine exists at the\n\noperation; or\n\n2. A diseased or potentially diseased swine is in the next\n\ndestination for the production line for the operation; and\n\n3. The owner of the concentrated swine feeding operation has\n\nreasonable cause to believe a swine has or may have any disease\n\ncausing:\n\na. a public health emergency,\n\nb. a substantial and imminent economic hardship to the\n\nowner, or\n\nc. a substantial and imminent threat to the swine\n\npopulation of the state; or\n\n4. The State Board of Agriculture issues an order establishing\n\ntemporary restrictions, a quarantine, or a quarantine zone\n\nrestricting the movement of persons, livestock, machinery, and\n\npersonal property out of a concentrated swine feeding operation.\n\nB. In no case shall a swine animal unit capacity be exceeded\n\nfor more than five (5) days following a confirmatory test indicating\n\nthat either the swine is diseased or is not diseased. A\n\nconfirmatory test shall be performed within twenty (20) days of\n\ndiscovery that a diseased or potentially diseased swine exists at\n\nthe operation.\n\nC. The owner of a concentrated swine feeding operation shall\n\nprovide written notification to the Oklahoma Department of\n\nAgriculture, Food, and Forestry upon discovery of a diseased or\n\npotentially diseased swine pursuant to subsection A of this section\n\nthat may result in the swine animal unit capacity being exceeded.\n\nD. The notice shall:\n\n1. Identify the concentrated swine feeding operation that may\n\nexceed its swine animal unit capacity; and\n\n2.
