In addition to any other requirement of the Oklahoma\n\nConcentrated Animal Feeding Operations Act, animal feeding\n\noperations owners and operators who are granted an animal feeding\n\noperations license shall:\n\n1. Provide adequate veterinarian services for detection,\n\ncontrol, and elimination of livestock diseases;\n\n2. Have available for use at all necessary times mechanical\n\nmeans of scraping, cleaning, and grading feed yards premises; and\n\n3. Provide weather resistant aprons adjacent to all permanently\n\naffixed feed bunks, water tanks, and feeding devices.\n\nB. 1. Any animal feeding operation licensed pursuant to the\n\nOklahoma Concentrated Animal Feeding Operations Act, operated in\n\ncompliance with those standards, and in compliance with the rules\n\npromulgated by the Board, shall be deemed to be prima facie evidence\n\nthat a nuisance does not exist; provided, no animal feeding\n\noperation shall be located or operated in violation of any zoning\n\nregulations.\n\n2. Any animal feeding operation licensed pursuant to the\n\nOklahoma Concentrated Animal Feeding Operations Act, operated in\n\ncompliance with those standards, and in compliance with rules\n\npromulgated by the Board, that is located on land more than three\n\n(3) miles outside the incorporated limits of any municipality and\n\nwhich is not located within one (1) mile of ten or more occupied\n\nresidences shall not be deemed a nuisance unless it is shown by a\n\npreponderance of the evidence that the operation endangers the\n\nhealth or safety of others.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"903f4457ea66753a6e11d2dc217d041f646137453efd40a0db16359e5af9e681","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-20-55","next":"us-ok/okla.-stat.-tit.-2-2-20-57"},"notice":"GroundRules: Original legal text.
