The State Board of Agriculture shall have the power to\n\nsuspend, revoke or not renew the license of any animal feeding\n\noperation after a hearing, and after an administrative determination\n\nthat the animal feeding operation has violated or has failed to\n\ncomply with any of the provisions of the Oklahoma Concentrated\n\nAnimal Feeding Operations Act, or any rule promulgated pursuant\n\nthereto.\n\n2. The Board shall have the power and duty to reinstate any\n\nsuch suspended or revoked licenses, or renew the licenses, upon a\n\nsatisfactory and acceptable showing and assurance that the animal\n\nfeeding operation conducted animal feeding operations in conformity\n\nwith, and in compliance with, the provisions of the Oklahoma\n\nConcentrated Animal Feeding Operations Act and rules promulgated\n\npursuant thereto, and that such conformity and compliance will be\n\ncontinuous.\n\nB. In order to protect the public health and safety and the\n\nenvironment of this state, the Board, pursuant to the Oklahoma\n\nConcentrated Animal Feeding Operations Act, may deny issuance of a\n\nlicense or transfer of a license to establish and operate an animal\n\nfeeding operation to any person or other legal entity which:\n\n1. Is not in substantial compliance with a final agency order\n\nor any final order or judgment of a court of record secured by any\n\nstate or federal agency relating to animal feeding operations; or\n\n2. Has evidenced a reckless disregard for the protection of the\n\npublic and the environment as demonstrated by a history of\n\nnoncompliance with environmental laws and rules resulting in\n\nendangerment of human health or the environment.\n\nC.
