Upon conclusion of its technical review of a Tier II or III\n\napplication within the permitting timeframes established by rules\n\npromulgated by the State Board of Agriculture, the Oklahoma\n\nDepartment of Agriculture, Food, and Forestry shall prepare a draft\n\ndenial or draft permit.\n\n1. Notice of a draft denial shall be given by the Department\n\nand notice of a draft permit shall be given by the applicant.\n\n2. Notice of the draft denial or draft permit shall be\n\npublished as legal notice in one newspaper of general circulation\n\nlocal to the proposed new site or existing facility. The notice\n\nshall identify public locations where the draft denial or draft\n\npermit may be reviewed, including a public location in the county\n\nwhere the proposed new site or existing facility is located, and\n\nshall provide for a set time period for public comment and for the\n\nopportunity to request a formal public meeting on the respective\n\ndraft denial or draft permit. The time period shall be set at least\n\nthirty (30) calendar days after the date the notice is published\n\nunless a longer time is required by federal regulations promulgated\n\nas rules by the Board. In lieu of the notice of opportunity to\n\nrequest a public meeting, notice of the date, time, and place of a\n\npublic meeting may be given, if previously scheduled.\n\nB.
