Stat. tit. 2, § 2-2A-5","heading":"Director of the Agricultural Pollutant Discharge","body":"Elimination System.\n\nA. The Commissioner of Agriculture shall appoint the Director\n\nof the Agriculture Pollutant Discharge Elimination System. The\n\nDirector shall serve at the pleasure of the Commissioner.\n\nB. The Director shall have experience in agriculture, forestry,\n\nconservation, environmental sciences, or other areas as may be\n\nrequired by the Commissioner.\n\nC. The Director shall not be an owner, stockholder, employee or\n\nofficer of, nor have any other business relationship with or receive\n\ncompensation from, any corporation, partnership, or other business\n\nor entity which is subject to regulation by the Department and, with\n\nregard to the exercise of powers and duties associated with the\n\nOklahoma Agriculture Pollutant Discharge Elimination System Act,\n\nshall meet all requirements of Section 304 of the federal Clean\n\nWater Act and applicable federal regulations promulgated thereunder\n\nby the United States Environmental Protection Agency regarding\n\nconflict of interest.\n\nD. 1. The Director shall have the power and duty to:\n\na. issue, deny, modify, amend, renew, refuse to renew,\n\nsuspend, place on probation, reinstate or revoke\n\nlicenses or permits pursuant to the provisions of the\n\nOklahoma Agricultural Code, and rules promulgated by\n\nthe State Board of Agriculture, and\n\nb. issue final orders and assess administrative penalties\n\naccording to the Administrative Procedures Act, the\n\nOklahoma Agricultural Code, and rules promulgated by\n\nthe Board.\n\n2. The powers and duties specified in paragraph 1 of this\n\nsubsection shall be exercised exclusively by the Director on behalf\n\nof the Oklahoma Department of Agriculture, Food, and Forestry and\n\nmay not be delegated to other employees of the Department except as\n\nspecifically provided in the Oklahoma Agriculture Pollutant\n\nDischarge Elimination System Act.\n\n3. In the event of the temporary absence of the Director, the\n\nDirector may delegate the exercise of these powers and duties to an\n\nacting director during the absence of the Director subject to an\n\norganizational structure approved by the Commissioner. In the event\n\nof a vacancy in the position of Director, the Commissioner may\n\ndesignate an interim or acting Director who is authorized to\n\nexercise the powers and duties until a permanent Director is\n\nemployed.\n\n4. Any designee exercising the powers and duties of the\n\nDirector as authorized or on a temporary, acting, or interim basis\n\nshall meet the requirements of subsection C of this section for the\n\nDirector.\n\n5.
