Whenever the Oklahoma Department of Agriculture, Food, and\n\nForestry determines there are reasonable grounds to believe that\n\nthere has been a violation of any of the provisions of the Oklahoma\n\nApiary Act, any rule, or any order of the State Board of\n\nAgriculture, the alleged violator shall be given the opportunity for\n\na fair hearing in accordance with the provisions of Article II of\n\nthe Administrative Procedures Act.\n\nB. 1. Whenever the Board finds that an emergency exists\n\nrequiring immediate action to protect the public health or welfare\n\nor to protect bees from any bee disease or pest, it may without\n\nnotice or hearing issue an order reciting the existence of an\n\nemergency and requiring that immediate action be taken to meet the\n\nemergency.\n\n2. The order shall be effective upon issuance, but any person\n\nto whom an order is directed shall comply immediately but may\n\nrequest within fifteen (15) days after the order is served an\n\nadministrative enforcement hearing.\n\n3. The hearing shall be held by the Department within ten (10)\n\ndays after receipt of the request.\n\n4. On the basis of the hearing record, the Board shall affirm,\n\nrevoke, or modify the order.\n\n5. Any person aggrieved by the final order may appeal to the\n\ndistrict court of the area affected within thirty (30) days.\n\n6.
