Stat. tit. 2, § 2-3-32.1","heading":"Definitions","body":"As used in this subarticle:\n\n1. “Broker” means any person who negotiates the purchase or\n\nsale of any nursery stock. A broker may or may not handle the\n\nnursery stock or the proceeds of a sale;\n\n2. “Certificate” means a document authorized or prepared by a\n\nduly authorized federal or state regulatory official that affirms,\n\ndeclares, or verifies that an article, nursery stock, plant,\n\nproduct, shipment, or any other officially regulated items meet\n\nphytosanitary, quarantine, nursery inspection, pest freedom, plant\n\nregistration or certification, or any other set of legal\n\nrequirements;\n\n3. “Compliance agreement” means any written document between a\n\nperson and the Oklahoma Department of Agriculture, Food, and\n\nForestry or the United States Department of Agriculture to achieve\n\ncompliance with any set of requirements being enforced by the\n\nDepartment;\n\n4. “Cultivar” means a horticulturally, silviculturally, or\n\nagriculturally derived cultivated variety of a plant, as\n\ndistinguished from a natural variety;\n\n5. “Dealer\" means any person who sells, brokers, or distributes\n\nnursery stock that was not grown from seeds, cuttings, liners, or\n\nsimilar propagative material by that person but was bought, received\n\non consignment, or acquired and in the person’s possession for the\n\npurposes of resale;\n\n6. “Facilities\" means and includes all buildings, greenhouses,\n\nstorage places, cellars, pits, trenches, bins, containers, packing\n\nmaterials, crates, packing rooms, display bins, refrigerators, ice\n\nboxes, and any other structures and materials used in storing,\n\ntransporting, and distributing nursery stock. The nursery, dealer,\n\nor agent shall maintain the facilities as are necessary for the\n\nproper care and conservation of nursery stock;\n\n7. “Grower” means any person who raises, grows, or propagates\n\nfor profit or other reasons any nursery stock or plant;\n\n8. “Heel yard” means any plant holding area;\n\n9. \"Horticulture\" means the discipline of agriculture science\n\nrelating to the cultivation of gardens or orchards, including, but\n\nnot limited to the growing of vegetables, flowers, and ornamental\n\ntrees and shrubs;\n\n10. “Landscaper” means a person who purchases nursery stock and\n\noffers that stock for sale or planting through landscape services\n\nand typically does not hold and maintain plants in a heel yard or\n\nnursery;\n\n11. “Native species” means a species that, other than due to an\n\nintroduction, historically occurred or currently occurs in that\n\necosystem;\n\n12. \"Nursery” means and includes any field, ground, greenhouse,\n\nbin, pit, plot, or premise where nursery or floral stock is grown,\n\npropagated, or sold;\n\n13. “Nursery operator” means the person who owns, leases,\n\nmanages, or is in control of a nursery, and any person who is a\n\ngrower of nursery stock;\n\n14. “Nursery stock” means and includes, whether in field or\n\ncontainer, all trees, shrubs, vines, rosebushes, turfgrass,\n\ncuttings, grafts, scions, fruit pits, herbaceous plants, evergreens\n\nand other ornamental trees, bushes, collected wild plants and trees,\n\ndecorative plants, tropical plants, flowering plants, bedding\n\nplants, vegetable plants for transplanting, aquatic plants, roots,\n\ncorms, rhizomes, bulbs, and ferns grown for propagation, all packing\n\nmaterials, and other things used in the handling, storing, crating,\n\nand shipping of nursery stock. “Nursery stock” does not include cut\n\nChristmas trees, wreaths, seeds, vegetables or fruits, agronomic\n\ncrops, cut or dried flowers, and cut or dried herbs;\n\n15. “Phytosanitary certificate” means a document issued by the\n\nDepartment indicating that the specified live plants or plant\n\nproducts comply with the legal requirements of the importing state\n\nor country. The document may be either a State Phytosanitary\n\nCertificate or Federal Phytosanitary Certificate;\n\n16. “Place of business” means each separate store, stand, sales\nrs, and cut or dried herbs;\n\n15. “Phytosanitary certificate” means a document issued by the\n\nDepartment indicating that the specified live plants or plant\n\nproducts comply with the legal requirements of the importing state\n\nor country. The document may be either a State Phytosanitary\n\nCertificate or Federal Phytosanitary Certificate;\n\n16. “Place of business” means each separate store, stand, sales\n\nlot, or any other place at or from which nursery stock is being sold\n\nor offered for sale;\n\n17. “Plant pest” means any pest known to cause damage or harm\n\nto plants, agricultural commodities, horticultural products, nursery\n\nstock, silvicultural interests, or the environment. Plant pest\n\nincludes, but is not limited to, insects, snails, nematodes, fungi,\n\nviruses, bacterium, microorganisms, mycoplasma-like organisms,\n\nweeds, plants, or other parasitic higher plants;\n\n18. “Sales location” means any principal business location\n\nwhere nursery stock is sold directly to a customer;\n\n19. “Sell” means to offer for sale, expose for sale, possess\n\nfor sale, exchange, barter, or trade;\n\n20. \"Silviculture\" means the development and care of forests;\n\n21. “Stop sale” means a legal document issued by the State\n\nBoard of Agriculture that prevents the production of or sale of\n\nnursery stock due to an infestation of a plant pest; and\n\n22. “Turfgrass sod” means a strip or section of one or more\n\ngrasses or other plants acceptable for lawn plantings which, when\n\nsevered from its growing site, contains sufficient plant roots to\n\nremain intact, and does not contain weeds in excess of the amount\n\nspecified by the Board.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4eba8deadd7d4199ca023255a17ce31453d4bdc2983f64e509b250a1e13476ae","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-3-311","next":"us-ok/okla.-stat.-tit.-2-2-3-32.2"},"notice":"GroundRules: Original legal text.
