Stat. tit. 2, § 2-3-32.8","heading":"Violations","body":"\n\nIt shall be unlawful for any person to knowingly or willfully\n\nviolate any of the provisions of this subarticle or any rules of the\n\nState Board of Agriculture by:\n\n1. Misrepresenting to another their connection with a nursery,\n\nor to:\n\na. misrepresent the grade, character, variety, or quality\n\nof any nursery stock,\n\nb. make a false declaration of acreage,\n\nc. conceal any nursery stock from inspection, or\n\nd. offer for sale nursery stock which is seriously or\n\nsubstantially devitalized;\n\n2. Failing to furnish the Oklahoma Department of Agriculture,\n\nFood, and Forestry with true and exact copies of order forms,\n\ncontracts, and agreements with customers;\n\n3. Failing to furnish each purchaser, upon request, a true and\n\ncorrect invoice of each purchase, stating the variety, quality, age,\n\nor size of the stock to which the invoice applies;\n\n4. Selling, offering for sale, or distributing any nursery\n\nstock infected or infested with a plant pest;\n\n5. Selling, offering for sale, or distributing nursery stock\n\nthat is not healthy, sound, and capable of growth;\n\n6. Failing to carry out treatment or destruction of nursery\n\nstock as ordered by the Board;\n\n7. Misrepresenting or falsifying information on a license\n\napplication;\n\n8. Doing business without a valid license;\n\n9. Allowing a license to be used by any person other than the\n\nperson to whom it was issued;\n\n10. Failing to notify the Board of the legal description of all\n\ngrowing locations of nursery stock or sod;\n\n11. Failing to allow an authorized agent to complete an\n\ninspection or collect adequate samples;\n\n12. Selling nursery stock restricted by a stop sale order;\n\n13. Selling, moving, or distributing nursery stock or other\n\nmaterial under a quarantine;\n\n14. Mislabeling nursery stock by using the wrong common name or\n\nbotanical name;\n\n15. Transporting any regulated article into the state from a\n\nquarantined area of any other state or country when the article has\n\nnot been treated or handled as provided by the requirements of the\n\nquarantine;\n\n16. Interfering with, hindering, or impeding, by any method,\n\nany authorized agent of the Board in the performance of duties;\n\n17. Falsifying or using false information to ship nursery stock\n\nout of Oklahoma into any other state in the United States or any\n\ncountry outside of the United States or making a false statement\n\nregarding the condition, quality, grade, character, variety, or\n\ntreatment used; or\n\n18.
