Stat. tit. 2, § 2-3-402","heading":"Definitions","body":"As used in the Oklahoma Industrial Hemp Program:\n\n1. “Department” means the Oklahoma Department of Agriculture,\n\nFood, and Forestry;\n\n2. “Fiber” means the stalk of the industrial hemp plant and\n\ndoes not include the flower or seeds of the plant;\n\n3. “Flower” means the part of the industrial hemp plant that\n\ncontains the majority of the industrial hemp plant’s\n\ntetrahydrocannabinol and other cannabinoids;\n\n4. “Grain” means all of the parts of an industrial hemp plant\n\nexcept the stalk or the flower of the industrial hemp plant;\n\n5. “Handling” means possessing or storing industrial hemp for\n\nany period of time on premises owned, operated or controlled by a\n\nperson licensed to cultivate or process industrial hemp and also\n\nincludes possessing or storing industrial hemp in a vehicle for any\n\nperiod of time other than during its actual transport from the\n\npremises of a licensed person to cultivate or process industrial\n\nhemp to the premises of another licensed person;\n\n6. “Industrial hemp” means the plant Cannabis sativa L. and any\n\npart of the plant, including the seeds thereof, and all derivatives,\n\nextracts, cannabinoids, isomers, acids, salts and salts of isomers,\n\nwhether growing or not, with a total delta-9 tetrahydrocannabinol\n\nconcentration of not more than three-tenths of one percent (0.3%) on\n\na dry-weight basis;\n\n7. “Key participant” means a person who has a direct or\n\nindirect financial interest in the entity producing hemp, such as an\n\nowner or partner in a partnership. A key participant includes an\n\nindividual who is part of a corporate entity or a tribal-owned\n\ncorporation. A key participant also includes an executive-level\n\nindividual such as a chief executive officer, chief operating\n\nofficer, or chief financial officer. Such term shall not include\n\nsuch management personnel as a farm, field, or shift manager or a\n\nmember of the leadership of a tribal government who is acting in his\n\nor her capacity as a tribal leader except when such member exercises\n\nexecutive managerial control over hemp production;\n\n8. “Licensee” means a person who holds a valid Industrial Hemp\n\nLicense to grow industrial hemp under the Oklahoma Industrial Hemp\n\nProgram. A licensee shall have the ability to remediate\n\nnoncompliant industrial hemp with a total delta-9\n\ntetrahydrocannabinol concentration of not more than one percent\n\n(1.0%) on a dry-weight basis for retesting as set forth by the\n\nDepartment as long as the noncompliant industrial hemp has a total\n\ndelta-9 tetrahydrocannabinol concentration of not more than three-\n\ntenths of one percent (0.3%) on a dry-weight basis after retesting,\n\nand the option to remediate the industrial hemp through the\n\nreasonable destruction of the flower or shredding of the entire lot\n\ninto a homogeneous biomass results in the remediation of any part of\n\nthe industrial hemp plant that is above three-tenths of one percent\n\n(0.3%) on a dry-weight basis. All noncompliant hemp must be tracked\n\nand documented. The State Board of Agriculture shall have\n\njurisdiction over such remediation, which includes, but is not\n\nlimited to, destruction through composting, burning, or other\n\nregulated disposal methods if the industrial hemp is not remediated\n\ninto a final product before processing below three-tenths of one\n\npercent (0.3%) on a dry-weight basis;\n\n9. “License” means authorization by the Department for any\n\nperson to grow and cultivate industrial hemp on a registered land\n\narea as part of the Oklahoma Industrial Hemp Program; and\n\n10. “Processing” means converting industrial hemp into a\n\nmarketable form, including the production of all derivatives,\n\nextracts, cannabinoids, isomers, acids, salts, and salts of isomers.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1e7935556ce62150f39657cbd82994a587f1e2e6196d709198c861850ef8b178","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-3-401","next":"us-ok/okla.-stat.-tit.-2-2-3-403"},"notice":"GroundRules: Original legal text.
